Sir,
I am also having the similar feeling but as we have received the cause list of our case from the Delhi High Court being heard on 12th of this month as ordered by
the Supreme court of India. The Hyderabad Association Case is posted as number
1 since it is at the admission stage, the other 3 are just transferred from Supreme
Court of India as a regular one. Hence there is no added advantage being No 1.
According to the para 29 of the Supreme Court order D/ 31 03 2016 " 29. As we are transferring the cases to Delhi High Court, the Registry of the High Courts of Punjab & Haryana and Rajasthan shall send the papers to the High Court of Delhi within three weeks hence. The learned Chief Justice of the High Court of Delhi is requested to constitute a Bench within four weeks from today.
We grant liberty to the writ petitioners to file requisite amendments, if so advised. Counter affidavit to the same shall be filed by the contesting parties within three weeks from the date of filing the amendments."
The first doubt has come to my little mind whether the Court admits the other parties to file a fresh writ in the matter.
Secondly, a reference is made to find out the constitutional validity of 3 (a), in such a
circumstances the admission of other parties is necessary. Any how, the cat is going to be out on 12th of this month. So, the numbering of the case does not add any
added importance as was pointed out in PC to my little mind.
I feel myself happy if any one of my learned friends enlighten me on this point.
I understand that L I C has not fulfilled its obligation to the Delhi High Court as was ordered by the Supreme Court of India under para 27 mentions " 27. Keeping in view the totality of facts and circumstances of the case, it is hereby directed that the Corporation shall pay 40% as per Para 3A of the Appendix to each of the employees within six weeks and shall file an affidavit before the High Court of Delhi to the said effect. " Hence we have to check up the reaction of the Delhi High Court in this
matter.
