All India Retired Insurance Employees’ Federation

Dear All LIC Pensioners Friends,

AIRIEF, a Federation of Divisional Associations of retired personnel of Class I, II, III & IV employees of Life Insurance Corporation of India, having maximum geographical spread, has been in existence for last 20 years. It has been espousing the case of retired people including pension updation at the time of every wage-revision and neutralization of dearness relief. Shri KML Asthana had filed two writ petitions in 1998 (for DR parity) & 2007 (for Pension revision) respectively in Jaipur HC for redressal of above grievances. AIRIEF decided to support him both financially and morally, in the Supreme Court. Subsequently, Mr. ML Gandhi filed a writ in Punjab & Haryana High Court in Chandigarh on the same issues and LIC Class I (retired) Assn. of Delhi filed a writ in Delhi. HC in 2007 for Dearness Relief. Pensioners were winners in all these three writ petitions. Subsequent victories were also there, like Gratuity case, MC Jain case etc.
However, these victories and WPs did not survive beyond 31-03-2016 when justice Dipak Mishra delivered a judgement. What survived was a direction of Supreme Court to Delhi HC to decide constitutional validity of para 3 A of Appendix IV of LIC pension Rules 1995.
Justice Mishra granted liberty to put up a case for pension updation based on rules & regulations. This was a great opportunity to make a fresh bid for pension updation in Delhi HC our Advocate, Shri Nidhesh Gupta advised us to do so. Shri KML Asthana was advised by Shri Gupta and us to amend his WP accordingly.
Despite repeated requests Shri Asthana did not do it. Legal Committee and Office bearers on 02-05-2016 and subsequent meeting and, on the advice of Shri Nidhesh Gupta, Sr. Advocate we (AIRIEF) decided to file a fresh WP incorporating above points. Shri KML Asthana, who is VP of AIRIEF, was present in all meetings of AIRIEF and at the limit of consultations with Shri Gupta. AIRIEF is impleaded as a party to this dispute, keeping in mind the fact “ GREATEST GOOD TO GREATEST NUMBER”. That was also the demand of members of AIRIEF.
Shri Asthana has done pioneering work. He is the author of the current legal battle. AIRIEF places him on the highest pedestal for this unique contribution. AIRIEF is conscious and sensitive to his falling health. All the Office Bearers individually and collectively take his care. AIRIEF reimburses him all expenses of travel in a AC car from Jaipur to Delhi & back. Office bearers of AIRIEF, including generally President / General Secretary or both accompany him to the Advocate and Court. AIRIEF is a caring organization.
Filing a separate WP does not imply that we are separate. Shri Asthana is still an integral part of AIRIEF. Our organization has been taking care of him and the legal case. Some misguided elements are probably poisoning his mind and disturbing his peace of mind.
Of late, it is observed that self-styled leaders make unsolicited advice to other organizations. It is an unwelcome move, disgraceful and tantamount to interference in the working of our organization. Such moves deserve all condemnation.
AIRIEF is an established entity. It has an excellent track record, team spirit and it functions democratically. It has sufficient inner strength to face any situation.
Trespassers please keep away and allow us to function. In case of need, we will seek their advice. For the present they should mind their own business.
I salute all pensioners of LIC for their cooperation & united stand.

S.S. Saxena
President
AIRIEF
