Hon'ble Justice Sanjiv Khanna and Hob'ble Justice Chander Shekar (one of
the new judges appointed on 8th Nov 16) were assigned for the above case. Our
Case was posted as Serial No. 30 in Court No. 6 (Double Bench VII).
Govt.
appointed committee submitted its report to the court. I understand that the
committee has given its approval with some riders (which varies from one BPS to
another) for the recommendations sent by the Bank on 27th April 2015 (with
regard to 5th, 6th, 7th & 8th Bipartite retirees - 50 % & 40 %) and
informed the same to the Court in a sealed cover. Though the committee
(appointed by Govt.) has approved the recommendations, Govt. has to approve it
(!!!). Hence the court has given 3 months time to get final approval. The case
is now posted to 7th Feb 2017 which may be the final hearing date.
In the
meantime, SBI Pensioners Federation has started in depth consultations with the
Circle SBI Pensioners Associations' to take a final decision whether to accept
committee's recommendation or to stick to 50 % as originally demanded. Further
date of implementation and various aspects has to be studied in regard to 5th
BPS, 6th BPS, 7th BPS & 8 BPS. This is a crucial issue which require wider
consultations, which Federation is doing now. HOWEVER THIS IS A RED LETTER DAY
FOR OLD SBI RETIREES. At last Govt. appointed committee has found that the old
retirees of SBI are suffering lot. Full details will be known only when it is
made known by SBI Pensioners Federation/Association.
As
regards 50 % of Last Drawn Basic Pay as basic pension and 30 % Last Drawn Basic
Pay as Family pension has not been approved by the committee, as it has to be
industry level . Hence as per committee these issues has to be finalised in
consultation with IBA and Banks.
Mr.
Upadhyaya's case at Delhi High Court today (8th Nov. 2016) Message received
from him around 12 noon.
A few minutes back, I received a SMS from Sri.Alex reading as under:-" Last opportunity is given to the Bank to file their counter, failing which they have to pay a cost of Rs 5000/-each to the petitioner in both the matter." The SMS was followed by a phone call to inform me further that both the writs will now be heard on 7.2.2017."
