3)The budget of 2017 has many provisions which affect an Individual taxpayer. Let us discuss these in detail.
1.Reduced tax rates for initial tax slab and imposition of surcharge on higher taxable income
Looking at the fact that the tax base of the tax payer is very narrow in the country as compared to other countries, the finance minister did not have the luxury of increasing the present limit exemption limit of Rs. 2.50 lakhs. In order to increase the tax base, the Finance minister has proposed reduced tax rate for the initial tax slab of Rs. 2.50 lakhs to Rs. 5 lakhs from 10% to 5%. This will reduce tax liability almost all the taxpayers. However in order to make up for the loss due to proposal of reduced tax rates, the finance minister has proposed to levy e surcharge of 10% on the taxpayers whose income is above Rs. 50 lakhs. Surcharge of 15% on the income above 1 Crore will continue to be levied.
2.Reduction in amount and eligibility for tax rebate under Section 87A
Presently an Individual tax payers is eligible to a tax rebate of up to Rs. 5000/- in case the taxable income does not exceed Rs. 5 lakhs. The Finance minister has proposed to reduce both. Now the eligibility for this rebate has been reduced to Rs. 3.5 Lakhs and the quantum of the tax rebate will also be restricted to Rs. 2500/- only so effectively individual with income less than 3 lakhs and senior citizens with income less than 3.50 lakhs will not have to pay any tax still will have to file income tax returns.
3 Revision of income tax return and fee for delay in filing of income tax returns
The time limit for filing of your income tax return was reduced by one year to the end of the assessment year by the previous budget. Meaning thereby that you can file income tax return of the year ending 31st March 2017 by 31st March 2018. Currently you are allowed to revise your return within one year from the end of the assessment year or before completion of the assessment whichever happens earlier. So the return for 31st March 2017 can be revised any time before the assessment is completed but by 31st March 2019. This budget proposes to reduce this time limit and bring the time limit for filing of the return and revising the return filed to before end of assessment year.
4.Reduction in holding period for immovable property and change in base year for indexation
Presently land and building qualify for benefits of concessional treatment as long term if the same are held for more than 36 months on date of sale. The budget proposes to bring down it to 24 months. This is beneficial provision for owner of the immovable properties. Presently, for the purpose of computation of capital gains, you have the option to take the fair market value of the property as on 1st April 1981 as your cost in case acquired before this date and apply the benefit of indexation on it. The budget proposes to move this from 1st April 1981 to 1st April 2001. This will be very beneficial for all the tax payers as the price appreciation between your date of acquisition and 1st April 2001 becomes fully tax free in your hand. Though you were allowed to index the market value on 1st April 1981 but the general price increase in capital assets have been more than the cost inflation index between these years.
5 Concession for partial withdrawal of NPS and higher deduction for non salaried persons
Till now the salaried are entitled to contribute and claim deduction for contribution to NPS account upto 10% of salary in addition to contribution by employer of 10%. So an employee can get deduction for 20% of his salary for contribution towards his NPS account, whereas a non salaried was allowed to claim deduction only 10% of his income. The budget proposes to remove this anomaly and make non salaried also to be eligible for deduction upto 20% of his income. Moreover presently 40% of the withdrawal from the NPS corpus on attaining 60 years of age is fully exempt whereas any partial withdrawal during continuance of the account is fully taxable. Now the budget proposes to make partial withdrawal upto 25% of the account holder contribution fully exempt.
6.TDS on Rent paid by Individual and HUF and
The budget proposes to cast a duty on the individual and HUF taxpayers to deduct tax at source @ 5% of the rent paid by them in case the amount of the rent exceeds Rs. 50,000/- per month.
7.Restriction on set off of loss on let out property
The budget also proposes to put a cap on set off of loss due to interest on money borrowed under the head income from House property against other income up to Rs. 2 lakhs for a year and the unabsorbed loss shall be allowed to be carried forward and set off against income under this head only.

Dear Comrades, Re: DELHI HIGH COURT PROCEEDINGS TODAY-AIIPA COUNSELS MAKE EFFECTIVE AND STRONG PLEAS
All India Insurance Pensioners Association's[AIIPA] Senior Counsel, Sri Nagmohan Das and
Advocate on Record, Sri Som Dutt Sharma made strong Pleas on the twin prayers of cent percent
neutralisation to pre-aug.1997 pensioners and updation of Pension, today and these were well
received by the Court.
Though there was to be no scheduled hearing, listed for the day our Counsels could insist and
secure a hearing today.
Our Counsels arguments were brief but effective and to the point. Our Counsels pointed out the LIC Pension Rules were not a package and that did not bar the Pensioners from demanding
improvements. It was argued and made clear that discussions between Employees' Associations and LIC Management in 1993/94 resulted in framing of Pension Rules and there was no settlement between
the parties under Industrial Disputes Act and as such estopped pensioners on seeking further benefits.
Our counsels told that Pension is a property under Art.[19], when it is denied on par with other equally placed persons, there is scope for challenging the inequality and the pensioners have the right
to improvements in pension and quoted a case law to bring out distinguishing features on discrimination, liberal interpretation in favour of pensioners and pension is a property.
It was strongly contended by our Counsels that LIC pensioners form a homogeneous group and are equals and there cannot be any discrimination on the basis of a cutoff date, based on their date
of retirement, which is violative of Art.[14].
On financial implications, for grant of cent percent neutralisation to Pre- August 1997 Pensioners, Counsels informed that LIC Board Resolution meant provision of about Rs. 141 Crores
between the year 2001 to 2016 and if payment of 40% Interim Relief and the balance 60% due was reckoned, the cost therefore is miniscule. At this point, the Bench observed that cost was not a factor,
even if it was more than the figure quoted.
On Updation of Pension for LIC Pensioners, irrespective of Date of retirement, our counsels argued that Central Government accepting Vth, VIth and VIIth Central Pay Commissions'
recommendations and by issuance of O.M.s, have extended pension updation to their pensioners though there is no such provision for pension updation in C.C.S.Rules, and pointed out
that when CentraL Government can grant pension updation to its Pensioners without any provision for pension Updation, there was no reason why similar benefit could not be extended to LIC Pensioners and appealed to the Court for grant of the benefit of pension updation to LIC pensioners.
On ripple effects in other sectors, if any benefit is granted to LIC pensioners, our Counsels
argued no concrete evidence has been placed.
Quoting Art[21], as man grows old requirements for health and other wants also increases, hence there is need for upgradation of pension on par with central govt. pensioners and other similarly
placed pensioners, Counsels wanted. Court observed that pension cannot remain static and there has to be periodical pension revision and that was a Corporate Social Responsibility, whether the pensioners have the legal right or
not.
When LIC's Counsel wanted to present a chart highlighting Dearness Relief at varying levels of indices indicating earlier Pensioners were getting higher Dearness Relief, the Court observed every
Pensioner must get Dearness Relief @ 0.23%, implying all are entitled for cent percent neutralisation
and advised LIC to file a fresh Chart.
It was AIIPA's day at the Court today and Our Counsels could utilise it to the full extent to impress upon the Court the legal merits and ethical needs.
The Next Date of Hearing has been fixed as February 20, 2017 and we may expect the arguments to be completed on that day or immediately thereafter.
All India Insurance Pensioners' Association is satisfied that it has put forth its best arguments to focus on legal nuances of our demands besides the cost aspects.
AIIPA hopes that its moves will enable it to ensure justice is meted out.

Or, you may jump to conclusions without knowing the whole story.
The truth is, you have no idea what another person has been through or what they're going through, so you don't have the right to make judgments.
We usually don't think about how our negative attitude and actions can make another person feel. Not only should we think about this before making the decision to act or think negatively, but we should also think about how we are going to feel afterward. More often than not, you will feel an overwhelming sense of regret and guilt.
Of course, we don't want to be the reason someone's feelings get hurt, but we still act in a way that might cause another pain. However, there is always room to become a better person. Everything we go through in life will teach us something, and so will this.
We should always make a point to change the parts of ourselves that we are not so proud of, because most times our negative actions will come back to bite us if we aren't careful.
People will always be judgmental, but that doesn't mean you can't strive to be better. Always show kindness to others, not only in your actions but your words too.
The next time you find yourself judging someone, think about how you would feel if you were in that position, and you'll think twice about making that judgment.

17)Dear Friends, The arguments in Delhi HC have concluded finally after 8 days of hearing from the 1st January 2017.
A brief note is being put as Circular no 20 .
All the petitioners may feel relieved but they have to wait for the DHC Judgement - now reserved- to be delivered after 10 days. Still we have got an unfinished job - to go to Supreme court to get their FINAL verdict.

10.The same rationale shall apply to the PS bodies falling within the meaning of Article 12 of the Constitution of India.LIC being a Public Sector Corporation owned by GOI, the same rationale shall apply as mandated under Rule 56 in fulfillment of the GOI 's objective in introducing Pension Scheme in lieu of CPF in LIC of India.
Dear Sir, Point 10 of the above is of paramount importance since I remember some time early 1980s the SC has said said that all PSUs, wholly owned by the Government, are deemed to come under classification as a State( Unit) under Art. 12 of the Constitution. I do not remember the case that was referred to SC whether by a State Govt/GOI.
I thought I could share this with you in this context. I am not sure whether this line of argument will be detrimental to PSU personnel in future. We have to weigh this aspect too when taking this line.

20)a)1) A query is raised as a grievance that those who paid FULL mediclaim premium last year,before COCircular came,are being DENIED the facility of deduction of mediclaim premium this year.
This does not look to be correct, & it is wrong to deprive such pensioners, who, out of good faith now approach the Office concerned to offer this facility.This is purely administrative & so ought not to be refused

From Feb 2017,Yly premium was divided by 12 for uniform Mly SZ did it this month with 1st Mly for 2017-18
No doubt,after New policy is announced,they will make adjustment,inform Pensioners Final picture
SO,don't keep quiet, get info from Bhubaneswar DO as also Cuttack or any DO,file ur letter with Pension Disbursing office
Pl know We AIRIEF fought for 3 years,then got it .We shd not revert to old Yly lump sum practice,as many forgot to pay before 31March,lost the risk cover for ever

b)Dear Shri Ramanathan , As per policy we are eligible upto Rs60000 but for cashless service the TPA has been authorized to sanction only upto `22000. It is because of irregularities found in a survey

c)But it is incongruous that through Cashless Scheme there is one limit and through reimbursement scheme there is another limit.We need to take it up with the LIC management for having a uniform practice. Ultimately cost of ONE was reimbursed ,then in Current year that Spl report is included in Regular list of reimbursible procedures .Try ur best in my case too.U know TPA rejected Non Medical Rs9000 during Hospitalisation at BRH TNagar for my Cellulitis of left leg/varicose vein
5) UR analysis of Employees mediclaim SA wise age groupwise is awaited.

--Dear Sir, 1. Reg. Sri.RS Ahuja's case, I am attaching scanned page of our policy which gives conditions for reimbursement of domicilary hospitalisation. You may verify the facts of the case for further action.
2. As you are aware, reduction is SA is not allowed as per the existing terms and conditions and our manual provisions, unless otherwise specific instruction is received from our CO.
3.With regard to Sri.SR .Nagarajan, as per our policy condition for the year 2016-17, for treatment of retinal disease by intravitireal/intraocular injection/intervention, only 25000/- per member per eye per year is admissible. Kindly request the pensioner to verify his case( same eye or not) and if admissible, give representation.
4. Our TPA has informed that For CT Angio, only Rs.5000/- is eligible. We will once again represent to the TPA to verify the same and revert back to us.

Sri RSAhujas case :AOMediclaim has sent attachment now, scan of the pages which gives conditions for reimbursement of domiciliary hospitalisation.
The only way to make hectic efforts & persuasion at Mumbai TPA,is ,she rightly says,to get a FORCEFUL Certificate from Doctor/Urologist of the unique & problematic nature of her problem, compounded by immobility ,long 35 kms away,restless situation,had to be resolved to remedy the problem,no aggravation shd be there & so this decision wast taken & amount paid to Urologist, Receipt sent etc.Also request ur Mumbai TPA to consider this as :Post Hospitalisation & Not Domiciliary.
Can u not talk to that SDM,New India who helped u in a considerable manner last time for organ transplant, is it .He can be an angel, even now,I pray.

It is correctly observed that those Organisations, who all along criticised our legal approach to resolve the pensioners vital issues, were woken up on SC order for 40 percent interim relief and directing the DHC to decide about the constitutional validity of para 3A.. Now they are engaging lawyers and impleading themselves as a part of the fighters in courts. It is amazing that why shouldn't they join hands together in the fight with AIRIEF for the common cause. On the same anology LIC has released 14 Slabs of DR TO PENSIONERS and reduced 9 slabs of DA to in-service employees wef 01,02.2017.
Please note the average AICPI-IW for the quarter ending December. 2016 was 6315.1
Thus there is reduction of 36.87 points [6352-6315-13]. Therefore 36.87/4=9 slabs of DA are to be reduced.
Hence the Average for employees =6352-36=6316.
Hence the same average is required to betaken for the Pensioners. There is increase of 14 slabs of DR ie 6316-6360=56 points.

& requested pensioners to make corrections, to add,subtract etc& return that Enclosure with a Covering letter with explanatory notes,for final issue of Form 16 in April 2017
PLEASE share info about ur Zones/Divisions & whether you have received such worthwhile letters or any procedure which, Zones,other than SZ are at present doing.That way, we can ask CO/ZO
to standardise a useful, correct procedure.--------
vi)Already last few months,Pension Credit to Bank with full particulars of Basic Pension, DR,Total ,mediclaim deduction,Net Pension credit clearly indicated, SMS reaches on last working day of earlier month
vii)ALSO, email/letter is issued every HalfYear,after DR slabs are announced,indicating Basic Pension, DR amount,Total Pension.WE have to preserve these records alongwith our earlier years IT file to connecr,verify & keep ready ,for final verification as soon as Form 16 is received from LIC & alongwith any other particulars,complete IT Form with TDS etc,& submit before 31 JULY 2017 ourselves or thro Auditor.
