JUDGEMENT
..... 20.
We have heard the senior counsel, counsel for the respective parties and
Baldev Singh who appeared in person at quite some length. The written submissions have also been filed by the parties which we considered thoughtfully.
LIKEWISE, recently in LIC case at Delhi High Court, the Judge allowed rather invited Com.M.Sreenivasa Murty(Retd Legal OFficer) representing LIC HYDERABAD RETIREES ASSN.,
to submit information and arguments in person for clarification on some aspects of Pension Regulations/ BONUSmatters.
Court proceedings on 21.2.2017:
Mr Nidhesh Gupta(NG), counsel for retirees, realized that retirees
were in danger zone and almost losing the Judge even on points clearly won
by them yesterday. Perhaps appreciating Com.srinivasa Murty (Com.SM) and Ashish's grave concern, NG very nicely suggested to Justice Khanna, pointing towards Com.SM, 'My Lord, my
colleague was formerly with LIC as legal officer, please let him explain these nuances', There
was instant acceptance and Justice Khanna gestured to Com.SM like telling 'OK, go
ahead'.
.......Justice Khanna interrupted Com.SM and asked his favourite question 'what about
bonus, is it not given away'?.......
......When Com.SM said, outgo on account of Pension is hardly 0.05% of the
Life Fund, before and after revision also, Justice Khanna reacted 'No, no don't say that you also said Life Fund is not meant for spending like that, if you say that it will go against you'. Com.SM said 'My Lord, I am only describing Pension outgo as a miniscule
portion of Life fund, I am Sorry I will rephrase my submission'. When Com.SM said "I
am Sorry My Lord", the Judge again interrupted and said, 'No, no, don't say Sorry,
you don't have to – you are helping us to understand these technical things.
We are laymen'................
