WHILE WE WAIT FOR THE VERDICT’ series by SHRI MSM

Editor sir,
Pl consider to publish the attached post in your/our blog.  I could not send it then and there due to some system problem.

    Regards

    M.V.P.R.Prasad,                                                                                                            16.03.2017

After  the  written  arguments  have  been  submitted   before  the  DHC,  there  has  been  a  sort  of  lull  but   within  few  days  came  up  the  posts  of Shri  MSM  under  the  captioned  subject  in  2  parts,  the 3rd one being  on  its  way.

Shri  MSM  has  explained   the  prevailing  situation  for  the  benefit  of  all  the  pensioners   in  very  clear  terms.   He  on  behalf  of  the  HYD  ASSN  is very  plain  and  honest  to  express  his  readiness  to  share  infn.  And  make  combined  efforts  and  extended  a  genuine  invitation  to  all  the  contenders  for the  balance  of  work  which  is  very  important.  .  It  remains  to  be  seen  as  to  how  the  spokesmen  on  behalf  of  the  other  5  petitioners  would  respond and  reciprocate.

Shri  MSM's  sincere  suggestion  that  all  the  parties  to  the  further  legal  fight  or  course  of  action  at  the  SC  should  seriously  and  conscienciously unite  is  the  URGENT  NEED  OF  THE  HOUR.  It  is  on  record  that  the  innumerable  appeals,  pleadings  and  advices  of  thousands  of   pensioners  earlier for  unity  and  unified  efforts  and  action  before  the  DHC  in  putting  forth  the  arguments  have  fell  on  the  deaf  ears  of  all  the parties  barring  the  Hyd Assn  which  was  in  fact  in  its   favour  right  from  the  beginning.   It  is  now  futile  to  lament  upon  whatever  has  happened  till  now  or  accusing  anybody.  I consider  that  the  entire  mass  of  the  LIC  Pensioners  are  very  much  in  favour  of  the  much  desired  UNIFIED  ACTION  even  at  this  stage.   I humbly solicit  of  all  the  case  managers  or  the  authorized  representatives  of  the  contesting  petitioners  to  volunteer  instantly   losing   no  further  time  to  open dialogue  among  themselves  with  the  avowed  purpose  of  forging   unity   to  initiate  unified  action  before  the  SC  very  shortly.   The  leaders  should   take their  membership  into  confidence  and   the  genera l members  too  have  the  responsibility  of  convincing  their  leaders  for  the  much  needed   UNIFIED ACTION  AT  THE  SUPREME  COURT.   I  feel  that  now  it  is  the  responsibility  of  the  members  of  the  respective  organizations  to  achieve  this  singular objective  of  unified  action  and  that  the  leadership    will  plunge  into  positive  action  immediately.  There  is  no  time  to  be  lost.   Lakadiasical  attitude  on  the  part  of  any  at  this  crucial  juncture  may  prove  disastrous !

I  may  recall  that  the  SC  has  clearly  stated  in  the  concluding  para  of  its  judgment / order  dt.31 Mar 2016  that "   IT  IS  DESIRABLE  THAT  A SINGULAR  JUDGMENT  IS  PASSED  SO  THAT  THE  VALIDITY  OF  THE  SAME  CAN  BE  ADJUDGED ".   As  and  when  the  DHC  pronounces  its  verdict, the  scene  automatically  shifts   to  the  SC.   What  urgent  steps  are  needed  to  be  initiated  must  be  visualized   before  hand  and   there  should   be  full  and  thorough  and  fool-proof  preparation  on  behalf  of  the  petitioners.   The  sum  and  substance   of   my   concern  through  this   post  is  that  in  deference  to the  offer  of   Shri  MSM,  all  parties  must  immediately  come  forward   to  join  hands  to  see  that  one  and  only  one  Sr.Advocate  is  engaged   on  behalf  of  all  the  6  petitioners  which  will  demonstrate  to  the  powers-that-be  that  the  pensioners  are  UNITED  and  are   not  a  divided  house  and  that  they  no   longer  tolerate  the  grave  injustice  heaped  upon  them  all  these  years

Before  concluding,  I  wish  to  congratulate  Shri  MSM  for  his  honest  offer  to  work  for  unity  with  open  mind.   Innumerable  no.  of  pensioners -- members   not   only   of   Hyd Assn,   but  non-members,   members  of  other  organizations  also    have  hailed   the  steps  taken  by    the  HYD ASSN   right from  the  beginning  up  till  now  and  the  latest  UNITY  OFFER  from  Shri  MSM  eloquently  speaks  of  his  sincerity,  eagerness   with  utmost   transparency with  the  only  objective  of  SECURING  THE  TWIN  BENEFITS  OF  PENSION  TO  ALL  THE  PENSIONERS  without  any  reservations..

Let  all  the  leaders  of  all  the  organizations   beware   that  even  if  a  100%  pensioners-favoured   judgment  is  awarded   by   the  Hon'ble   DHC, more  strong  and  concerted   efforts  would  be  called  for  at  the  SC  to  clinch  the  final  verdict  in  total  and  unqualified  favour  of  the  LIC  PENSIONERS.

If  the  aspirations  and  appeals  or  prayers  of  the  pensioners'  community  are  secured  and  fulfilled  by  dint  of  the  much  craved  UNIFIED  ACTION,  there  will  be  no  greater  history  for  the  'retired working class'.   It  is  a  naked  truth  although  quite  unpalatable  that  the  active   and  vociferous community  of the in-service   'WORKING  CLASS'   have  not  expressed  one  word  of  supp ort  or  solidarity   to  the  cause  of  the  pensioners, not  even   sympathy  even  being  fully  conscious  and  aware  that  today's  working  employee  is  going  to  be  tomorrow's  pensioner  !

I  apologise  for  this  unduly  long  post  but  It  is  conveyed  with  the  honest  intention  of  persuading  the  parties  to  the  issue  to  do  something positive  and  substantial  keeping  in  view  the  welfare  and  well-being  of  all   the  LIC  PENSIONERS.   I  take  this  opportunity  to  express  my  whole-hearted appreciation  for  the  sacred  and  honest  efforts  of  Shri  MSM  to  enlighten  the  pensioners  at  large  with  an  unrelenting  missionary  zeal,  he  has  drawn  out plans  and   programmes  to  visit   number  of  places  to  meet  the  anxious  pensioners  and   reinfuse  confidence  and  hope  of  eventually  winning   the  legal battle  at  the  SC.  His  visit  to  Vizag  on  14th  March  has  been  a  good  success  with  good  no.  of  pensioners  attending  the  meeting,  he  has  visits  to Bengaluru  on 17th,  Kolkata  on  22nd  and  so  on.   May  HIS  MISSION  SUCCEED  with  the  DIVINE  BLESSINGS  !

               Sincerely yours,

               M.V.P.R. Prasad
