Thanks for the reply to my concern through email dated 28 April, 2017.
Sir, I hold you in high esteems for your hard work and sincerity in the service of LIC pensioners.
I have no intention to blame anybody, but had requested for cautious approach in future based upon our past experiences. Let the Petitioners and the Associations consider forming a UNITED FRONT or a CONFEDERATION to fight this legal battle in the Supreme Court for full justice which has been denied to LIC Pensioners by DHC Judgment of April 27,2017. This suggestion has also been mooted by a number of other retired employees.
Further I shall humbly request you to please go through my following submissions with a cool & open mind so that introspection of the past experiences may pave a better line of action for the future.
Without dragging the issue , I have to submit that your contention that had the Fresh Writs not been filed the benefits granted ,if any, would have gone to only petitioners, is totally wrong and mis-placed. Sir, you are well aware that as per Supreme Court orders, IR was paid to all eligible retired employees (not only to petitioners) and there were only 3 old petitions ie. of Sh KML ASTHANA & others Jaipur, Fed.of LIC Cl I Delhi and Sh ML Gandhi & others Chandigarh. Further, we all are aware that AIRIEF was supporting Jaipur; Delhi by Cl I Fed., and Chandigarh by Sh.Sreenivasa Murty Mulukutla from Hyderabad, till the Supreme Court vide their orders dated 31.3.2016 (para 29) transferred Jaipur & Chandigarh cases also to Delhi and granted liberty to these petitioners to file requisite amendments, (which they filed), and the Delhi HC was also requested by the Supreme Court to dispose of the writ petitions by the end of August, 2016.
At this stage the respective Associations and Sh Sreenivasa Murty could continue their full support to the petitioners, instead of filing fresh writ petitions, as was suggested at that time also and could save lakhs of rupees besides time and energies.
Any way since the intentions and aim was to get full justice to all pensioners, lets forget the past and now move ahead collectively and unitedly and forge a United Front or a Confederation of all the Petitioners and Petitioner Associations, till we achieve our goal of Revision of pension on every wage revision of in service employees. I am sanguine that all our respected senior leaders must be burning mid night oils in studying the 90 pages DHC Judgement to decide further course of action.
DHC has disposed of all the writs including the following six:-
1. KML ASTHANA & ors. Vs LIC of India Jaipur.
2. Federation of Cl 1 Officers vs UOI
3. ML Gandhi & ors. VS UOI & ors.
4. Retd.LIC cl 1 off. Assn.,Hyderabad vs LIC of India & ors.
5 All India Retired Insurance Employees Federation vs LIC & ors.
6. All India Insurance Pensioners Assn. vs UOI & ors.
In view of the fact that very critical situation has been created by DHC judgment, it is desirable and expected that any one or more of the above may call a joint meeting to take stock of the present circumstances and chalk out future course of a united action plan to achieve the goals.
Since final decision may rest with Hon'bl Supreme Court only, a senior Advocate preferably Sh. Nidesh Gupta, who has been representing our cases both in Supreme Court and DHC, has strong grip of all the pros and cones including the legal intricacies of our case, may be engaged for a united legal fight/appeal on behalf of all petitioners & petitioner Associations, (shedding away any egos or different ideologies by the Associations or any individual )for the common cause of all LIC pensioners.
Hope my above submissions will be taken in the right perspective by all concerned.
