Our
Review Petition is not intended to serve the purpose of an appeal.The
fact that we had pointed out a need for rectification in DR formula
ordered by DHC does not mean that we have accepted the logic of DHC.We
are going to contest the verdict in its entirety while filing SLP to the
extent the verdict is against the pensioners' interest as a whole.The
purpose of suggesting rectification in the DR formula for pre-April 1993
retirees is only to point out the inconsistency in the judgment against
the Bench's own rationale followed in modifying the DR formula.
Not
only Development Officers,but also Class III & IV retirees besides
some AAOs at lower levels of Basic Pension would also have been adversely affected.The adverse effect is more on family pensioners
majority of whom will be in the Basic Family Pension of less than Rs
1250/- & Rs 2400/- under paragraph 1 & paragraph 2
respectively.They constitute about 30% ot the total pensioners.
Real justice hinges on upgradation of pension which is the core subject matter of prayer in the SLP before SC.
