OUR ISSUE OF REVISION (UPDATION) OF PENSION -, A SUGGESTION.

CONGRATULATIONS TO THE CENTRAL GOVERNMENT PENSIONERS/FAMILY PENSIONERS.                       
    The Central Government vide their  OFFICE MEMORANDUM. Dated 17th May, 2017  NO.38/37/2016-P&PW(A) Ministry of Personnel, PG & Pensions Department of Pension....New Delhi have accepted 7th CPC   recommendations to revise ( up grade) pension also. Read Para 4 of the memo. reproduced below.                                    
    ""4.The afore said Committee has submitted its Report and the  recommendations made by the Committee have been considered by the Government. Accordingly, it has been decided that the revised pension/family pension w.e.f.01.01.2016 in respect of all Central civil pensioners/family pensioners, including CAPF's, who retired/died prior to 01.01.2016, may be revised by notionally fixing their pay in the pay matrix​  recommended by the 7h CPC in the level corresponding to the paying​ the pay scale/pay band and grade pay at which they retired/died.This will be done by notional pay fixation under each intervening Pay Commission based on the Formula for revision of pay........................       ""                         
BUT THESE ORDERS DO  NOT APPLY TO  STATUTORY BODIES LIKE LIC. See Para 20 of the memo. below.                                             
   ""20.  These orders do not apply to retired High Court and Supreme Court Judges and other Constitutional/Statutory Authorities whose pension etc.is governed by separate rules/orders. ""
            WHAT DOES IT MEAN TO US. 
IT MEANS UNLESS CENTRAL GOVERNMENT AMEND OUR PENSION RULES 1995 TO INCLUDE REVISION OF PENSION ON EVERY PAY REVISION OF EXISTING EMPLOYEES  LIC PENSIONERS ARE NOT ENTITLED TO REVISION (UPDATION) OF PENSION.
  Hon'bl SUPREME COURT has also clearly & unequivocally observed in their order dated 31.3.2016 that LIC BOARD RESOLUTION cannot be implemented unless rules are amended by Parliament.         
    My humble submission to the PETITIONERS ASSOCIATIONS is  to PLEASE PLEASE PLEASE  do consultant their Senior Advocates, Legal Advisors, Leaders whether they can convince SUPREME COURT to change their order and say that revision (Updation) of Pension can take place without amending Pension Rules. Failing which all SLPs for Revision of Pension will be a futile exercise at a heavier cost of money time and energies. My these free and frank views may not be appreciated by many of pensioners leaders, but a clear writing on the wall cannot be ignored and as such please do ponder over this important point and move cautiously.
