DISGUISED UPGRADATION FOR MEDICLAIM CATEGORISATION

We are fighting a long legal battle for securing upgradation of pension with every wage revision.But there is an area where a notional upgradation is inherent for categorisation for Group  Mediclaim  Cover.

Supposing a retired( post- 1/8/2007)  officer in the cadre of ADM is in category I before 1/8/2012. If his pre-retirement Basic Pay is not upgraded notionally,he may fall in a lower category after 1/8/2012 wage revision.So such a retired employee is treated as continuing in the same category even after the wage revision effective from 1/8/2012.This principle followed is tantamount to notionally upgrading  the Basic Pay slab for the Group Mediclaim Scheme categorisation without upgrading the Basic pension!
The boundaries  of the revised Basic Pay slabs  are also so fixed as done for fitment of Basic Pay  on wage revision with more or less the same weightage after merger of DA.
The illustration prepared by me taking the fitment stages near the Basic Pay boundaries for Mediclaim categories is attached.
This can be used at the time of arguments to the extent possible in the SC to strengthen our pleadings for  pension upgradation. We may need to  explore the possibility.
