Re: Anomaly thrown up by Delhi High Court
upgrading Minimum Pension
While calculating the upgraded minimum pension and upgradation in minimum family pension arising out of the Delhi High Court judgment dt 27/4/2017, I observed an anomaly whereby the pensioners/ family pensioners who were drawing basic pension marginally above the minimum pension came to be at a disadvantage because their gross monthly pension (without upgradation) was less than the gross monthly pension drawn by pensioners on minimum pension on upgradation for the month of August 2018.This was a common feature both in regular pension and family pension.
Another anomaly noticed was that upgradation does not really happen to pensioners retired from 1/8/2007 and 31/7/2012 placed on minimum basic pension as the minimum pension fixed as at 1/8/2012 gives a gross pension in August 2018 which will be less than the existing gross pension on the minimum pension fixed as at 1/8/2007.
I attach two Tables bringing out the anomaly in respect of regular pensioners and family pensioners.Kindly consider how this anomaly can be eliminated for equity among pensioners.
