Open letter General Secretary, AIIPA

Ref : Your circular Nos. 22 & 23.

Respected Sri. T.K.Chakraborty, GS, AIIPA,

I had the privilege of going through your above circulars, published
in Shri. R.K.Sahniji's ' Pensioners' Voice. I am delighted to find the
follow-up actions initiated through organizational avenues. One could
understand the pains taken to convince the members and also the management to settle the issue in favour of pensioners retired on or before 01-08-1997. I wish to elicit your kind clarifications on the
following:-
  1. The efforts taken by AIIPA on ' Revision of Pension ' and
hundred percent neutralization of DR prior to the judgments of three
High Courts.
  2. Part played by AIIPA in the  ' Resolution ' passed unanimously
by LIC Board in 2001
  3. What prompted AIIPA to jump into legal battle belatedly, when it
has got full hopes, even today, of getting the matters settled
satisfactorily long before through bilateral discussions ?
  4. Whether the cooperation of your parent-body was ever sought for ? and, if so, to what extent it has extended its support ?
  It is not my intention either to find fault or hurt any organization which is fighting for the welfare of all cadres of pensioners. Being open may clear the lingering doubts in the minds of pensioners.
  Should we not impress upon the working colleagues that we are not
only fighting for the current pensioners, but for future pensioners too ? The same sad atmosphere prevails in the banking sector also. But we refuse to witness the present trend that exists in the midst of
Reserve Bank employees and pensioners, where we could see  all classes of working employees stand shoulder to shoulder with retired employees and fight for the cause of ' Revision in Pension '. Why then there is this lapse in our crusade ?
  There is a long cry from amongst us as to why all the working and
retired employees in the public sector undertakings should feel shy of giving a combined fight against the onslaught of bureaucracies in denying our genuine demands. One should admit that we have wasted our
energy in finding fault with others and concentrating upon searching
causes to safeguard and escape from the wrath of our base units.  Why, then, we failed to approach the government demanding suitable amendment in the pension rules ? Should we to presume that we have understood this lacuna only after the dawn of belated wisdom ?
  A few learned activists say that our pension rules say the following :-
  1. Our pension is linked with cost of living index.
  2. Wherever there are gaps in our pension rules, the provisions
found in Central Govt . Pension Rules will apply.
  Kindly confirm whether AIIPA agrees to these findings or disagrees.
  3. You have emphasized the force of the findings of Nakkara case in
your communication addressed to Chairman, LIC of India. But the courts appear to have not concurred with our arguments. How do you rationalize that your stand on those lines are quite different from that of the earlier submissions made by others.
  I am quite a lay man in respect of the above legal matters. You
must be thorough on all the above, based on the knowledge and
experience gained out of your closeness with the situation and the issues.
  I will be much obliged and thankful to you, if a detailed reply is
posted in the same blog addressed to me with a view to clear all my
above confusing doubts.
