1)After Supreme Court Verdict, What Needs to Be Linked With Aadhaar and What Doesn't

Bank accounts and mobile phone no longer need to be linked, but PAN card and income-tax returns still require Aadhaar. For over a 100 welfare and government subsidy schemes, mandatory Aadhaar will continue.
New Delhi: The long-awaited Supreme Court judgement on the constitutional validity of Aadhaar is finally out.
While the five-judge bench, in the three-judge majority opinion, has effectively upheld both the unique identification project and the Aadhaar Act 2016, it has placed a number of restrictions on how who can demand Aadhaar and what services or schemes it can be used for.

While the full verdict is yet to be placed in the public domain – which would provide a more detailed reasoning on the validity of Aadhaar for each service – here's a quick primer on where you will be required to furnish your biometrics and where you won't.
Bank accounts: Don't need to be linked.
In his remarks in open court, Justice Sikri went one step further and noted that changes to the PMLA (Prevention of Money Laundering Act), which mandated Aadhaar linking with bank accounts, were unconstitutional and do not satisfy the legal test of proportionality. This, incidentally, is an argument The Wire has made before.

Mobile phone connections: Don't need to be linked.
During the course of the hearings, the five-judge bench had pulled up the government for a department of telecommunications (DoT) notification that mandated Aadhaar for both getting new SIMs and re-verifying old SIMs that had been gotten through the traditional paper-based KYC route.
In his remarks, Justice Sikri noted Aadhaar linking for mobile phones is not backed by an underlying law or change to an existing legislation.
"For the misuse of such SIM cards by a handful of persons, the entire population cannot be subjected to intrusion into their private lives. It also impinges upon the voluntary nature of the Aadhaar scheme. We find it to be disproportionate and unreasonable state compulsion," the judge said on the DoT notification.


PAN card and I-T returns: Yes, it appears likely that Aadhaar-linking for PAN cards will still need to be done.
The majority opinion has upheld Section 139AA of the Income Tax Act, which was the subject of a separate legal battle earlier this year. This is something The Wire has extensively analysed and documented.
Simply put, Section 139AA makes it mandatory for income tax assesses to quote their Aadhaar number in their income tax return and link it to their PAN cards.
While a smaller bench of the Supreme Court had partially read down a part of this section earlier this year — in particular, the penal provisions that kick in if one doesn't link their Aadhaar to the PAN card — it appears that today's judgement has overruled the previous ones.

Education schemes: Aadhaar will not be required for most education schemes and entrance exams.
In his remarks in open court, Justice Sikri devoted some time to specifically tackling whether authorities such as CBSE can make Aadhaar mandatory for exams like NEET. He noted that they could not and added that enrolment of children could only happen with "parental consent".
"…CBSE, NEET, JEE, UGC etc. cannot make the requirement of Aadhaar mandatory as they are outside the purview of Section 7 and are not backed by any law," the judge's opinion notes.
"They should also be given an option to exit on attaining majority," the judge added but did not clarify on whether an opt-out provision for Aadhaar would be allowed.
He also noted that Sarva Siksha Abhiyan and other education schemes that demand Aadhaar now cannot make it mandatory.

Private entities: They cannot demand or use Aadhaar for their services and applications. Section 57 of the Aadhaar Act has been struck down, with regard to the "body corporate" provision. This means a host of financial-technology services, like Airtel Payments Bank, that use Aadhaar as a means of on-boarding customers will not be allowed to do so.
Other companies that have used Aadhaar APIs (application programming interfaces) to provide employee-verification services will also have to find a different business model and underlying technology.

Welfare schemes: A great majority of the Modi government's welfare and subsidy schemes will still require Aadhaar. Over a hundred schemes that have mandated Aadhaar through notifications issued using the power of Section 7 of Aadhaar Act will still require usage of the biometric authentication programme.
In their reasoning, the majority view expressed through Justice Sikri's opinion noted that Aadhaar was striving to benefit millions of deserving people and therefore could not be scrapped merely on the ground that "there is a possibility of exclusion of some of the seekers of these welfare schemes".
While Justice DY Chandrachud held that Section 7 of the Aadhaar Act was unconstitutional, the majority opinion felt that the "baby cannot be thrown out with the bathwater".

ORDER
(a) The impugned judgment and order dated 16th April, 2013 made by the CAT is hereby set aside.
(b) The petitioner is held entitled to receive the benefit of MACP with effect from 1st January, 2006 together with all consequential benefits.
(c) The respondents are directed to work out the benefits of MACP with effect from 1st January, 2006 together with consequential benefits and to pay the same to the petitioner as expeditiously as possible and in any case within a period of three months from today.
d) If, such benefits/consequential benefits are not paid to the petitioner within three months from today, then the respondents will liable to pay interest thereon @ 6% p.a. from the date such payments became due and payable, till the date of actual payment.
(e) Rule is made absolute in the aforesaid terms. There shall however be no order as to costs.

You are right in your post about Court dates.
Initially we have only 11th and 12th October, Thursday and Friday, ie two days only. S.C. has Dassehra holidays from 15th to 20th (Monday to Saturday) October and again Dewali holidays from 5th to 11th November (Monday to Saturday) apart from usual Saturdays and Sundays offs.
2 more holidays are in November. So our Advocates need to squeeze maximum Hearing hours in the last week of this month itself.

I am sad to know, from sources, that you are unwell because of pain in your legs. Is it arthritis attack?. Incidentally I am also victim of pain in my knees. I am aged 87yrs. I do understand your compulsions about free movements, but despite  the pain you are very seriously devoted to the welfare of the pensioners. With your activities you are ignoring your pain and further deterioration.

Your sincere efforts to boost the benefits towards pensioners at such stage is commendable, since I personally know the pain in movements. My SALUTES to your sacrifice and courage.
I can only PRAY to ALMIGHTY to give you healthy long life.

When I joined LIC in 1986, Mr. Lakshmanan was SDM, Coimbatore.
He was residing in our area of Kilapuk and many a times I met him during morning walks.

11) Dear RBK,  It is really sad to hear the news that Sri N S Lakshmanan is no more.He was a GREAT MAN
I met him for the first time in 1955 at Poorna Prasad, Race Course Road, Bangalore, where he was one of the Faculty training us at the New India School of Insurance - which I attended as an apprentice trainee from Madurai along with a few others.
I distinctly remember his loud, clear, well modulated address to us the trainees .Then I met him again at a training centre at Chennai LIC.
Later in 1988, I met him leading the Coimbatore Division as Sr DM, where Mr. Ramanathan was the MM, and Mr. K. Sridhar was in charge of Unit2 and Mr. N.V.Subburaman was in charge of Unit1 and I had the opportunity to serve as the BM in charge of Career Agents' Branch - North Coimbatore. He used to come to our office on visits.
I am sorry that we are missing him. I spoke to his wife and consoled her on the irreparable loss that she suffers.
May his soul rest in peace

I always read out MY TRIBUTE to the departed friend & pensioners in the presence of mourners, pensioners & family members.
Some on earlier occasions had told me,it is done in such graceful, appealing style, we family members did not know earlier much about.So some have framed, some have laminated & preserved etc

* TRIBUTE TO LATE SRI N.S.LAKSHMAN
       The news of the death of the noble SeniorOfficer,LIC at Chennai  is a great shock.Many are aware he was completely bedridden with full support of every need  ,an unconscious person needs full maintenance as in Hospital.Such was the condition in which he was & such is the family wonderful treatment with  caretaker nurse & other equipments & accessories ,so meticulously & thoughtfully provided at exhorbitant cost for human welfare.
Sri NSLakshman was a born Trainer & Teacher.LIC Staff of all hues & colours,Administration & Marketing, wherever he served,remember him with goodwill & gratitude.His Training classes used to be unique & special.The manner of introduction, his ready touch with the trainee audience, the Films on Management, Marketing, Public Relations bore his stamp of nearness, one to one correspondence with questions & answers, ready wit & wisdom, his repartees galore,steadfast in communicating LIC Vision & Mission statement to the Field Force in particular, Branch Officials,Development Officers, Club Agents of repute were a ready hit with humour interspersed.
Sri N.S.Lakshman was a successful Captain & Commander of LIC Divisions he served.He was a  Specialist &  go-getter in LIC Group Schemes.All remember how LIC was a forerunner & a mighty force with records created & records broken & new watermark of Excellence in later years, thanx to such solid foundation for the sprawling  Pension & Group Schemes ,where LIC is simply unbeatable. He retired from Coimbatore as SDM ,placed in ZM Scale. 
His Classes on Behavioural Science for many Cadres instilled the virtues of importance OF Motivation & proper Communication skills ,he drove home with aplomb & distinction.I used to invite him for Lectures, when I was Principal ZTC, Chennai  long back.I learned a lot while attending & I could visibly see the changes in demeanour, the inter –personal skills demonstrated in select Exercises & Management Games,which used to be a treat.Such  self introspection by Learners is the real change which must get transmitted in work situations, when other groups attend training sessions.In fact absorption, assimilation, operationalisation are the gateways to change,which in todays world takes individuals & institutions by storm, as it were.
It redounds to the credit of Sri NSLakshman,that he has carved special niche in Training & Human resources development & produced in turn many quality Trainers of head & heart who subsequently managed all tiers of Training in LIC which has such a wonderful architecture for training & even private sector used to be astonished at various facilities for a learning environment so conducive to create many Teams worthy to carry this noble,lustrous institution called LIC to greater & greater heights of glory & superlative achievement.A monopoly of yester years facing such grave competition from 24 private life companies & holding its head high after 18 years with a dominant  market share in policies & premium income is a rare Success story judged by history as a jewel in the crown
May many more LAKSHMANS dawn, may the Almighty shower courage & fortitude to bear this loss,admirable human & humane support at home made his life linger long.It was a saga of sacrifice,in this extreme condition by Mrs Parvathi Lakshman  & his family for such noblest of support provided.   As a former Executive Director LIC & his wellwisher,as a VP,AIRIEF doing our best for the progress & welfare of LIC Pensioners,with Court cases stretching for 2 decades for so-called Elders & Sr Citizens,shame on Govt to interfere & delay,negating National Litigation policy of Govt itself, is a mockery of law & justice.We admire the gracious legal fund donation call responded always,with gratitude.

15)Friends , ​ The Bank(RBI) had invited us for meeting with following email message.
"Group Mediclaim Policy for the year 2018-2019 is renewed with Bajaj Allianz General Insurance Co Ltd. It has been decided to conduct 
post-renewal meeting  with representatives of M/s Bajaj Allianz Insurance Co, M/s Aditya Birla Insurance Brokers(our Insurance Broker) ,​
 representatives of four Third Party Administrators (TPAs)  and representatives of Retired Employees Association at 11.00 AM on October 9, 2018". ​

While attending the said meeting we have Thank ekud the Bank for whatever improvements made &  placed following points before the Bank.
  1. Although the Room rents increased by Rs. 500/- per day, no increase has been given in ceilings. As a result it does not help retirees  to meet over all expenses including that of pre and post hospitalisationIn the back ground of GOI introducing  the ceiling of Rs five lakh  under the Ayushmann  Bharat w.e.f. 15th August 2018 against annual payment of Rs 1324/- , the Bank's ceilings to RBI retirees are very poor. 
           The Bank may please consider to revise upward ceiling amounts given in the GMP circular under reference. 
  2.  The bank has continued its old policy to deduct proportionately on certain items in case retiree goes for higher rent room above his /her eligibility. 
        It has no rationale and logic. We demanded to review this issue seriously when ours is a tailor made  policy.
  3.  The Bank may please provide in agreement  imposing  penalty on Insurance company / TPA on delayed payments in terms of IRDA.
  4.  On settlements of final bill by TPA a statement may please be invariably provided as to which items passed for payments and which are not considered for payment.
   5. In case of chronic ailments, the system of periodical permission from CO may please be done away. Instead life certificate may please be sought.

  6. List of Hospitals may please be prepared Alphabetically  and provided to each retirees. This would help the retirees in emergency situation. This was agreed instantly.
   7. Technical terminology in the circular may be simplified to understand even to layman.

  8. We also requested Insurance agent to conduct pathological investigations at the earliest.  They have agreed for it. 

Apart from GMP issues we also had separate meeting with the Bank and  TPA -OPD.The Bank is serious about shortcomings in the scheme and interested in making improvements by taking some measures. It so transpired that wherever payments are delayed those are to be spotted and with the help of us also they want to resolve such cases. For this purposes each unit may please provide name , his mobile number and email address to me. He should be a devoted person to the cause of retirees. In turn HRMD would provide all details about pending bill and also inform requirements of TPAs. As only 2 and half months are left we have to work on war footing.
Also units may help retirees who are unable to understand the scheme properly. They may please prepare instructions list in local language and distribute amongst such members.

We have also attached here  information sought on pension fund under RTI Act. by Shri BV Sonawane-Vice President of Mumbai unit.

WE CAN DRILL THESE ARGUMENTS only when we see face to face LIC TOP Mgt & make them understand   that too long,Mgt has treated Pensioners at arms length ,with disdain & NO EMPATHY whatsoever
Wonderful Emails point by point quoting provisos,modest & legitimate demands only, we submit logically to LIC Chairman,MD,ED Per,ED OS & others months before negotiations  but very little improvements take place.

     Quis custodiet ipsos custodes? is a Latin phrase found in the work of the Roman poet Juvenal from his Satires (Satire VI, lines 347–348). It is literally translated as "Who will guard the guards themselves?", though it is also known by variant translations.*
     The original context deals with the problem of ensuring marital fidelity, though it is now commonly used more generally to refer to the problem of controlling the actions of persons in positions of power, an issue discussed by Plato in the Republic. It is not clear whether the phrase was written by Juvenal, or whether the passage in which it appears was interpolated into his works.

Original context
     The phrase, as it is normally quoted in Latin, comes from the Satires of Juvenal, the 1st/2nd century Roman satirist. Although in its modern usage the phrase has universal, timeless applications to concepts such as tyrannical governments, uncontrollably oppressive dictatorships, and police or judicial corruption and overreach, in context within Juvenal's poem it refers to the impossibility of enforcing moral behaviour on women when the enforcers (custodes) are corruptible (Satire 6, 346–348):

The Supreme Court on Friday, October 26, said it would supervise the inquiry against CBI Director Alok Verma and the probe should conclude in two weeks. It also appointed former Supreme Court judge Justice A K Patnaik to monitor the investigation.
The matter will be heard again on November 12.
The Bench, presided over by Chief Justice of India Ranjan Gogoi, stated that M Nageswar Rao, who has been put in temporary charge in place of Verma, would not take any major policy decision. He will take decisions only on routine matters essential to keep the agency functioning.
A list of decisions taken from October 23 till Friday will be submitted to the court in a sealed cover. This will include decisions on transfers of investigating officers and related matters.
Though the courtroom was unusually crowded with an anxious gathering of lawyers and activists, the judges succeeded in easing the tension with a few light-hearted remarks.
When the three judges conferred at length with each other in whispers, counsel was curious to know what they were discussing. The Chief Justice told him it was not about the Alok Verma case. "We discuss so many other things too," he remarked. 
When Solicitor General Tushar Mehta pleaded for more than 10 days to complete the enquiry ordered by the court, the chief justice said "then we will give you 240 hours".
When Mehta again requested more time, pointing out that the records went through hundreds of pages, the judge said, "We go through thousands of pages."
The next appeal was on the basis of the approaching Diwali holidays. Again the judge responded: "Doesn't the CBI work on holidays?"
The law officer then appeared to have exhausted his quiver.
A CBI spokesperson said the agency would follow the court directions in letter and spirit and, if necessary, seek legal opinion on what decisions could be taken in the interim.
Sources in the CBI, though, said this might hamper the investigation of several high-profile cases.
"Work will now be basically file movements from one desk to another as both the government and the agency would not like to antagonise the court," an official said.
The agency is investigating fugitive industrialist Vijay Mallya; AugustaWestland; the IRCTC case, in which Rashtriya Janata Dal chief Lalu Prasad and his family members are named; and the Aircel-Maxis case, in which former Union minister P Chidambaram's son Karti is an accused.
Verma had moved the Supreme Court, challenging the Centre's decision to divest him of his responsibilities. In his petition Verma had said the government had violated the rules, which gave a fixed tenure to the CBI director.
The unprecedented situation became further complex as several officials investigating sensitive cases including bribery allegations against Special Director Rakesh Asthana were transferred.
Asthana too on Friday moved the Supreme Court but when former attorney general Mukul Rohatgi, representing Asthana, tried to intervene, the court refused to hear the petition, saying it was not listed.
After receiving all the reports, the court will pass "appropriate orders", it stated. The present order is an interim arrangement till the next hearing on November 12.
The judges made it clear that this order on supervision by a retired judge was a one-time exception. It did not cast any aspersion on the functioning of the Central Vigilance Commission.
"The court has virtually disabled the new CBI director," said lawyer Prashant Bhushan who filed a plea under the banner of NGO Common Cause, opposing the decision to divest Verma of his powers.
The Bench, which also included Justice Sanjay Kishan Kaul and Justice M K Joseph, heard leading counsel Fali SNariman, who represented Verma for a short while.
Counsel argued that the CBI director had been granted a two-year term in the Supreme Court judgment in the Vineet Narain case of the 1990s. This rule was later incorporated in the CVC Act in 2003 and the Delhi Police Establishment Act, which deals with the CBI's powers.

Incidentally, even the DR arrears paid , LIC states it was for 3630 pre-8/97 pensioners,for Rs23.08 cr ie Average of Rs 63581,which judged from Date they chose 29/1/2007  ,earliest Court Writ, instead of 18/12/1998, 6676/1998 of Sri Asthana is too meagre & miserly,by any standards for Pensioners of a reputed & glittering Service & Financial institution like LIC

  COMING to MOST Important , I ransacked SC WEBSITE,endeavoured to compress the LIMITED number of working days in SC Calendar ,which we do,with all our heart,but as we experienced on  earlier occasions,to ensure if Hon Justice Lokur Bench can or can at all deliver Judgement, so NEAR & YET SO FAR.
Working days are NOV 2018:Monday to Friday 26 Nov to 30 November
                              DEC 2018:Monday to Friday ,3 Dec  to  7   December
                              DEC 2018: Monday to Friday 10 Dec to 14 December
DEC 16th is Sunday,December 17 ,2018  to 1st January 1st 2019, Christmas & NYHolidays
What a tragedy Hon Justice Lokur virtually retires on DECEMBER 15th Saturday!!

No detouring or digression should take place EXCEPT as a passing mention of errors committed & INFORM SC Bench that AFTER all submissions are over, they reserve the Final Verdict with attention paid for rectification  of errors & restoring WRONG deduction of 40 % IR

ii)5 WORKING DAYS ITSELF,with Pressure applied legitimately on SC Bench be sufficient for all Petitioners

iii)If the route for Pensioners is studded with illluck & final Judgement  timing fails,what is the ALTERNATIVE ?

 iv)Telling then that ,PENSIONERS will have to go thro full rigmarole, again enacted with the NEW BENCH , is the very ANTITHESIS of Continued, Committed Progress of cases monitored by SC Registry

 BUT for NOW , as Hon Lokur earlier expressed his intention to complete & close the case with his final Verdict, that ,every pensioner will aspire  & pray for the real culmination of true justice for the sufferring humanity of elders & pensioners longing for 20 years,

v)17,500 pensioners have died,
LFDonations  all along with respect & discipline, poor pensioners have contributed to respective Assns, such a lackadaisical treatment to the Founders /Pensioners by LIC & UOI,Premier Financial Instn neglected in the scheme of things by Govt

vi)who otherwise treat LIC as a Kamadhenu & ATM to govt for any need or stock market operations,bale out Instn for sinking Banks,IDBI,IL& FS with a staggering NPA, all to affect Policyholders & other stake holders,

vii)whereas Pension payments are miniscule, addition to Pensioners every year is just 1950 app,

viii)Family Pensioners jumped in Numbers as many RP died, 17 % to 35 % & in some Zones FP to RP is as high as 40 %,

ix)Outlay on PU worked out every DR Halfyear shows moderate Rs 210cr per annum wef 1/8/1997,even Midday Meals Coupon for ALL Employees per annum has crossed Rs 550cr pa. &

x)above all NPS is already set in motion from May 2010 & so PU is NOT INDEFINITE  & so all arguments against PU fall like a pack of cards,as it becomes close-ended

xi)The claim of Govt Pensioners for PU ,total outlay NEXT YEAR will cross Govt Employees Salary Outlay,what more than simply decide the case

 xii)on Constitutional Points,solid case laws,Violation of Fundamental Rights Article 14.16.& 21 of Constn coupled with Discrimination between groups of pensioners

&xiii) Anamolies obnoxious & abominable,violating the accepted canon of Same Pension for Same cadre for Same length of Service & at no time can a Junior cadre get more pension than their own Seniors,

which Hon Dipak Misra in Rajasthan University College professors & Teachers characterised as HOSTILE DISCRIMINATION ,which has to be remedied thro PU,he added.

xiv))Since fresh thinking, out- of- the box alternative Plan A & Plan B  have to be worked out,to enable us  to introspect & make a Valiant effort  for a turnaround in pensioners direction with positive body languages & repartees by eminent SC Bench
AIRIEF Legal Study Group is working hard to resolve ,with grit & determination, as arguments are cogent,logical & substantive & will fix up dates to meet our Sr Counsel ,with particular emphasis for MENTION & to to have daily hearing during the last phase
