Dear Sirs,
It may be a coincidence that yesterday I raised the same issue with our Advocate Shri R K Singh. Shri C H Mahadevan Sir also expressed his concern on the issue of delay as well as emerging economic scenario.
Yesterday, I had a talk with Shri R K Singh in the context of 'on line hearing' inquiring whether we may explore this arrangement. Shri R K Singh informed that SC is hearing cases 'on line' and also issued instructions to HCs and other lower courts to adopt 'on line' hearing at their level also. He further informed that 'on line' hearing is allowed only in very urgent cases. In fact, for on line cases also, soft copies of entire record is required by the judges, which is a very difficult job as in the registry, there are no sufficient staff to scan the records and send to the judges. Presently, only very urgent cases of national importance are heard on line. Possibility of our case falling in such category is rare. But, Shri R K Singh gave a hope that as soon as the situation comes to normalcy, it is learnt that SC is considering to clear the backlog by working extra. Courts may work on Saturdays as well as Sundays. The vacation would also be cancelled. He told that even if courts are allowed to work after April end or mid-May, they would cover the back log caused due to COVID-19.
As regards the impact of deteriorated economy on our judgment, our Sr Advocate has to prepare for its satisfactory reply. As opined by some experts, our case is for the relief from discrimination under Article 14, etc of the Constitution, perhaps it would not be affected adversely by the slowing economy. We have to discuss this aspect with our Sr Advocate to counter adverse pleadings, if any.
This is a quick response to the query of Respected Shri Narayenen Nan Sir.
Our leaders-Hon'ble Patron, President and GS and others would definitely take up the issue on priority. LSG will also ponder over the issue and offer the suggestion to protect the interest of senior and super senior citizen, under the prevailing circumstances.
With regards,
M P Agnihotri.
