Pension Updation

 The justification for upgradation of pension hasn't  cropped up suddenly due to Rule 66 of CCS Pension Rules 2021.It had already attained  legality and legitimacy with the implementation of the Recommendations of the 5 th Central Pay Commission  with effect from 1/1/1996.


The repealed CCS Pension Rules 1972 might not have had a provision for revision of pension, but the Central Government pensioners were nevertheless paid revised pension from 1/1/1996 by issue of Office Memoranda soon after the decision was taken by the Central Government to implement the Recommendations of the CPC.

Rule 56 of LIC Pension Rules 1995 clearly stipulated that wherever there is no express provision in the rules, the CCS Pension Rules 1972  will apply. The LIC Pension Rules were notified on 28/6/1995 at a time when even  Central Government employees were not eligible for upward revision of pension. The application of CCS Pension Rules 1972 also includes  the  application of extended benefits outside the CCS Pension Rules 1972 through issue of Office Memoranda related to implementation of CPC Recommendations. This is what has happened in respect of Chairmen( now Chief Executives) and Managing Directors who retired after 1/1/1996 as per Rule 55 B notified on 23/8/2001.
In other words, implementation of Rule 56 for LIC employees will be effect from 1/1/1996 and not as a result of Rule 66 of CCS Pension Rules 2021.The appropriate Rule will have to be inserted in our Pension Rules 1995 by a Notification of an amendment.But our claim for giving effect to upgradation of pension is valid from 1/1/1996  and our SLPs in Supreme Court definitely support this.
The provision of Rule 66 in CCS  Pension Rules  2021 is only a documentation and validation  of the upward revision practised by the Central Government through issue of Office Memoranda.Harping on transplanting  a rule corresponding to Rule 66 will adversely affect our claim for retrospective effect for pension upgradation.

Sir,

Please go through the trailing emails regarding  Revision of basic pension of LIC Pensioners,  which should now be allowed as the Central Government has already added Rule 66 in CCS PENSION RULES (2021),regarding Revision of pension,
AND THE SAME IS  ALSO APPLICABLE TO LIC PENSIONERS  IN TERMS OF  RULE 56 OF LIC EMPLOYEES PENSION RULES. 

I take this opportunity to remind Hon'ble Chairperson of LIC of India to please take cognizance of the revised Rule and long pending  issue of LIC PENSIONERS REVISION OF BASIC PENSION  be taken up with DFS/MF for immediate resolution. 
LIC  may also refer to their own replies given  to PMO in reference to my appeals Registered Nos. PMOPG/E/2021/0003884 and PMOPG/E/2021/0024094.

Since the hurdle of "NO RULE" has been removed, the DFS/GOI- MF is again requested  to exercise Powers vested in Central Government under Sec. 48 (2) of LIC Act, 1956 and  issue necessary directions to LIC to REVISE/UPGRADE  basic pension of LIC Pensioners without further delay, as the matter had been lingering on for decades in the absence of  a Rule.
Let GOI honour its OWN LITIGATION POLICY and save all from unnecessary loss of Time, Money and Energies .
Hope the concerned authorities will also be pleased to act positively.

  URGENT AND IMPORTANT 

KIND ATTENTION DFS INSURANCE.

You have  stated  in  remarks
dated 22.9. 2022 to  PMO in reference to GRIEVANCE REGD. NO. PMOPG/E/2022/0244868 dated 16.9.2022, that there is no provision for revision of the pension with every wage revision, in LIC of India (Employees) Pension Rules1995, which is not correct.

 As you are aware,  the Central Government has, in November 2021, added Rule 66 - REVISION OF PENSION...in CCS PENSION RULES    (appended below for ready reference), which is applicable to LIC PENSIONERS also as per Rule 56 of LIC of India (Employees) Pension Rules 1995, which, interalia says   :- 

 **Matters relating to pension and other benefits in respect of which no express provision has been made in these rules shall be governed by the corresponding provisions contained in the Central Civil Services (Pension) Rules,**

Accordingly, LIC PENSIONERS including Family Pensioners are legally entitled for Revision of their basic pension with every wage Revision of existing employees.

 In view of the above Legal Rules, DFS must, immediately initiate necessary administrative action to amend their previous remarks given in GRIEVANCE REGISTERED NO. PMOPG/E/2022/0244868, and,  exercising powers vested in the Central Government under Section 48(2) of LIC ACT 1956, ask LIC to implement the rule of Revision of basic pension of LIC PENSIONERS, and pay the difference  without  any further delay, as this most genuine and legitimate demand is pending for decades due to no fault of the LIC Pensioners.

CCS PENSION RULE  66. Revision of pension after authorisation.- (1) The pension authorised under rule 44 and family pension authorised under rule 50 may be revised by the Government in accordance with any general order issued in implementation of decisions taken on the recommendations of the Central Pay Commissions, or otherwise, and the pension or family pension so revised shall thereafter be the basic pension or basic family pension for grant of

Till date there has been no positive action to address the GRIEVANCE nor permission to meet you personally, which gives a feeling of deprivation, agony and harassment to thousands of the seniors and super seniors who are in December of their lives like me.

Sir, I hasten to re -submit that resolution of the GRIEVANCE lies with the Central Government headed by you Sir, which has full powers in terms of Section 48 (2) (cc) of LIC Act, 1956. to amend or modify "LIC of India Pension Rules 1995" and allow Revision / updation of basic pension of LIC Pensioners alongwith every wage Revision of existing employees.

At the cost of repetation, I request PMO to please again refer to LIC 's replies given to PMO in reference to my appeals Registered Nos. PMOPG/E/2021/0003884 and PMOPG/E/2021/0024094, and LIC had written that :-

*The Pensionary benefits to the employees of LIC of India are governed by LIC of India Pension Rules, 1995 which have been framed by the Central Government in terms of powers vested in the Central Government in terms of Section 48 (2) (cc) of LIC Act, 1956. According to these Rules, the definition of Basic Pension is expressly provided. Any modifications / amendments in these Rules can be done by the Central Government.*

Thus the ball lies in the court of Central Government and as Head your blessings are required, Prime Minister, Sir.

SIR, it is also a well known fact that Basic Pension of Central Government Pensioners gets revised on every wage Revision of existing employees of Central Government, even though there is no such Rule for Revision of Basic pension in Central Government Employees Pension Rules 1972.( it's only in Nov 2021 that a rule to revise pension has also been added in these rules).
So Sir, why step motherly treatment with LIC Pensioners. They also deserve Revision /updation of their basic pension.

Further and most importantly Sir, there is no financial burden on the Central Government, nor the Finance Minister has to make any Budgetary provisions if basic pension of LIC PENSIONERS is revised/updated.

Hope this time, your Excellency and PMO will not disappoint me and thousands of super seniors like me and will immediately initiate necessary action to address the grievance.
