The justification for upgradation of pension hasn't cropped up suddenly due to Rule 66 of CCS Pension Rules 2021.It had already attained legality and legitimacy with the implementation of the Recommendations of the 5 th Central Pay Commission with effect from 1/1/1996.
The repealed CCS Pension Rules 1972 might not have had a provision for revision of pension, but the Central Government pensioners were nevertheless paid revised pension from 1/1/1996 by issue of Office Memoranda soon after the decision was taken by the Central Government to implement the Recommendations of the CPC.
Rule 56 of LIC Pension Rules 1995 clearly stipulated that wherever there is no express provision in the rules, the CCS Pension Rules 1972 will apply. The LIC Pension Rules were notified on 28/6/1995 at a time when even Central Government employees were not eligible for upward revision of pension. The application of CCS Pension Rules 1972 also includes the application of extended benefits outside the CCS Pension Rules 1972 through issue of Office Memoranda related to implementation of CPC Recommendations. This is what has happened in respect of Chairmen( now Chief Executives) and Managing Directors who retired after 1/1/1996 as per Rule 55 B notified on 23/8/2001. In other words, implementation of Rule 56 for LIC employees will be effect from 1/1/1996 and not as a result of Rule 66 of CCS Pension Rules 2021.The appropriate Rule will have to be inserted in our Pension Rules 1995 by a Notification of an amendment.But our claim for giving effect to upgradation of pension is valid from 1/1/1996 and our SLPs in Supreme Court definitely support this. The provision of Rule 66 in CCS Pension Rules 2021 is only a documentation and validation of the upward revision practised by the Central Government through issue of Office Memoranda.Harping on transplanting a rule corresponding to Rule 66 will adversely affect our claim for retrospective effect for pension upgradation.
