REVISITING DHC JUDGEMENT AGAIN

Did LIC flout the judgement while paying the DA arrears?
YES will be the overwhelming response I know.

But I differ. My answer is a firm NO.

First let us look at what the court has said in the matter.

The court has said that the 40 pc interim relief paid as per SC order need not be refunded or repaid.PLEASE NOTE THAT THE COURT HAS  NOT USED THE WORD "ADJUSTED". the FA   

Let us go further deep into the issue.

Out of the judgement three sets of pre 8/97 retirees have emerged.

1) pensioners not eligible to any relief at all - example - persons of rule 2 of appendix IV having BP upto 3850/- but were eligible for SC relief. Did LIC ask these pensioners to return the interim relief? NO.

2) pensioners eligible for DHC relief  but the relief being less than the interim relief. Did LIC ask these pensioners to refund the excess amount received by them? NO.

3)Pensioners for whom DHC relief was higher than the interim relief. In these cases LIC  ADJUSTED the interim relief from the DA arrears which is not barred by the court. 

Therefore it is unfair to blame LIC on this count. If at all anybody is to be blamed it is the DHC for not having written its judgement without ambiguity.

But LIC has been guilty of letting    down the pensioners at least on four earlier occasions about which I will give details in my next post.
