1)Excerpts from our letter to Hon Judge (Retd) V.R.KrishnaIyer

 Any slight dislocation or disturbance in the unalloyed & unadulterated enjoyment of those Rights,Courts must immediately step in & bring harmony & justice. Courts must issue Directions to the delinquent authorities with a positive Order --  

a)----to uphold Human Rights mercilessly trampled upon, taking 13 long years to arrive at a decision,                                                                         

                            

b)--when High Court has given verdict in favour of pensioners,                             

c)--when LIC Board’s clear & distinct Resolution dt 24/11/2001 with positive solution for both Dearness Relief & Pension revision  exists.

       LIC Board Resolution of 24/11/2001  unnecessarily kept in the  melting pot for so long & still more unjust & unwarranted Review Petition,after Appeals were dismissed , to create havoc is indeed a reverse master stroke .Oh Justice, where are you, we ask. Reply is Whither or Wither !

d)--when LIC has written to MOFinance on 20/2/2009 & 6/5/2009 to grant 100%  DR to pre-8/97 pensioners(CPI 600 & 1148) &  fitment with the next group of pensioners,(CPI1740)

e)----when such Noble Resolutions & Honourable Judgements cannot & must not be guillotined or killed by Ministry of Finance.

f)--more so when thousands of pensioners have died without securing the retiral benefits in the manner & quantum in which pensions had to be paid with equality amongst all Groups of pensioners, Who is answerable to them,How can we take it lightly as though it is a non-event,   

                        all these  certainly attract consternation & anger, & Courts must punish such guilty conduct with severe penalty

The human rights enshrined have to be protected & strengthened by the SC, not weakened.

SC is not a mere noun, it is an adjective too.Therein lies its Supreme importance & impartiality to protect the weak against arbitrary policies of Govt & institutions.    4/2010

2) If your all pervasive and heart and mind convincing letter to the Board members does not evoke any positive response in them, we have to feel sorry for their cruel heart as well their unrealistic mind.
I have no words to express my sentiments. I am sure the Almighty will get melted by your tireless efforts for the common noble cause despite your personal constraints.---

3) Excerpts from our Letter to Chairman, Human Rights Commission

The treatment meted out to Elders is far from satisfactory.

It assumes many forms –

*apathy, indifference,neglect of their interest, welfare  ignored, *insensitivity of organizations & Government, 

*insensitivity to their genuine, modest & legitimate demands,

*lack of response  & inordinate delay in settlements.

*You are considered as a Torchbearer of the most invaluable human Rights ,which cannot be trampled upon by ANY agency whatsoever.HR is supreme,HR is unconditional,HR is inviolable. You have championed the cause of the adversely affected groups,whoever they may be,to bring redressal of inequity & establish modicum of justice.   3/2011

4) Sri Mohan Talekar,GS, RBREA, Mumbai was confident justice is on pensioners’ side. He said 'never ever have fear. Be fearless. Doubt & uncertainty are the enemies of success.Let us not create worry, If anyone has worry, ask him ,to write on a piece of paper, in the morning when he wakes up, to list & afterwards, to bring a matchstick &burn that paper, lo, worry also flies away & disappears. Let us not create a 'syndrome of paralysis  thro  analysis.'. There is no case in history of Courts where pensioners ever lost, it has been singularly in their favour.

 He added that in the case of Kerala Warehousing Corpn ,where also a somewhat similar Resolution was there, when Govt wanted the KWC to rescind the Resolution, they went to Court & got strictures & everything went in f/o pensioners.   3/2011

5) First of all, I am moved by the patience  & reticence you are exercising in the current situation in the family.-- The way you are playing your role in the Organization is just unique. I see it as it emerges from your mails. But it must be much beyond and gape wonderstruck at the levels of energy that you apply to all that, dedication, meticulousness, speed and command on articulation - all apart!

 That you sent me what I needed (earlier 2 issues of Varistha Vaani) and also thoughtfully sent the Souvenir makes me so grateful to you. That you personally handled the dispatch had not escaped my noticing. Your bookpost came along with Shri Sanjeeva Rao's brochure on the matter-- The Souvenir spoke of the immense organization you people have built up for LIC retirees. I have been saying to bankers what scope exists for organizing themselves if we have the LIC yardstick.

6) There can be ties in World Cup matches.But as far as LIC pensioners are concerned, there can only be a decisive victory for them, thanks to the immortal LIC Board Resolution!
Let us hope LIC recognizes that they have to be above board by understanding that they are not above(LIC) Board!

7) All these mails point to the singular fact that Mr R.B.Kishore is a clearing house for vital and valuable communication among the LIC pensioners, who perhaps were, in my judgment, till more than a year ago, were not so much in electronic proximity to each other as now.Mr Kishore with his astounding energy has admirably succeeded in bonding LIC pensioners together.
MAY THIS BOND LAST FOR EVER GETTING STRENGTHENED CONTINUOUSLY WITH POSITIVE RESULTS FOR LIC PENSIONERS.---

8) There is a Chinese proverb: “It is better to take many small steps in the right direction than to make a great leap forward  only to stumble backward.” Precisely  this is what LIC did and were  shown the door by the Hon'ble Supreme Court.   You have rightly summed up that we should rejoice the positive developments. Success is more sweet when it comes in parts and there is no doubt that we are inching towards FINAL VICTORY.

A couplet by the great Ghalib comes to my mind: "Koi mere dil se poochhe, terey teere neem-kash ko' voh khalish kahan se hoti jo zigar ke paar hotaa..." - ( If asked, without hesitation, I would admit that I relish the sweet pain of the sharp arrow aimed  at my heart by my beloved; which  did not pierce through it and left a lasting sensation ).

10)Only a handful of pensioners are in the know of the details. Many do not have

e mail id and they do not get the real and complete message.  Further, this will go a long way in

(1) enlightening the members and other non-members

(2) creating an atmosphere for solidarity

(3) stopping the gossips from the vested interest ones 

 4) clearing the confusion in the minds of the retired employees of LIC as to who are the real achievers and whose sweat and toil has caused this victory    

 (5) Making everybody realise by whom their cause has been really taken care of.

11) When we go back in memory the tremendous work output we have done,in the last 13 yrs or so, the papers, computer word & email jottings & Archives etc, it dawns in our mind progresssively, we are indeed   handling important, very important & most important as we come to this grand finale.   It is a Final Battle.We have entered the tallest peak of Mt Everest

With fervent prayers ,the best lawyer with solid reputation to be carefully chosen, enough we can hand over & enough he shd do to take us to that memorable victory ending long drawn wait & frustration for pensioners granting them, as it were , a new lease of happy life in their twilight years.

12)History has its own calendar, and the significant date has arrived on 14th November,2011 as a harbinger of a glimmer of hope and happiness for us pensioners.Coincidentally,the foundation for this development was laid on 24th November 2001, , i.e a decade ago by the LIC Board resolution

LIC in their SLP laboured hard to defend the powers of the UOI u/s 48.But the judicial development in the SC only demonstrates clearly , that if any power that is claimed even legally is not appropriately and responsibly used by the powerholder in time, such power slips out of his hands.
This seems to be a lesson for those who believe in the arrogance of power to act and also not to act.The arms of justice take over the reins sooner or later.

It is indeed an unprecedented moment for LIC pensioners, when a path for further progress has been firmly laid through the creative order of SC, thanks to the long, persistent,tenacious and untiring struggle of Mr Asthana against all odds..—C.H.Mahadevan  14 Nov 2011

I too welcome the Crescendo to the Final legal  battle in Supreme court than inevitable intermediate   skirmishes in lower ones.No other course of action was expected from LIC nor was it possible for any authority in LIC to deviate from this course. On first day of LIC was written , as to how it will exercise its autonomy ( ! ) ,which will continue to be read till the last Day.

IV)Further followup with NABARD,Updating our Submissions more forcefully with this LATEST POSITIVE ,also throwing light on Effective Date,with the already  Favourable SC orders that Pension matters be given full & liberal coverage & interpretation,& our liaison with Sr Advocate so wellversed ,to be professionally  & thoroughly motivated to ensure our PRAYERS for TWIN benefits of Pension Upgradation with Every Wage Revision to set right Gross Anamolies of 7 Grades below getting more pension than their Seniors & DA/DR Discrepancy of pre -8/1997 pensioners getting 50% DR only & not FULL 100 % DR on par with Post -8/1997 pensioners & Employees & violation of Fundamental Rights of Articles 14,16 & 21  in complete justification of our most GENUINE DEMANDS & 23,500 pensioners having died/&are dying, to be justly compensated ,as TIME is of the essence for Pensioners.
