PART IV of the Amendments needs to be studied by us in detail and we need to firm up our thoughts on how relevant they are to points raised in our Civil Appeals.
We need to particularly study the Supreme Court judgment of the case adjudicated in 2024.
It will give us a clue for strengthening our grounds for our case in SC.
But one thing that is clear is that any changes that may be effected to our LICEPR 1995 cannot be with retrospective effect but only prospectively, as Pension is declared property under Article 300 A and the right to arrears on past entitlements as part of the property of the pensioner cannot be taken away .
