The hearing of our case started at about 11.15 AM. Mr. Ramakrishnan (Federation of Retd Class 1) started with a submission that as directed by the Bench he has submitted a common compilation of pleadings and judgements. Mr. Ranjit Kumar appearing on behalf of the LIC agreed that the petitioner associations have submitted 4 volumes which need to be studied in the light of rules and regulations. He further stated that he has also prepared a compilation of rules and regulations.  


After hearing advocates of both sides, the Bench ordered for a common compilation of old pleadings, judgements, rules and annexures afresh prepared by petitioners within 2 weeks. Next date of hearing is fixed on 3rd December 2025.


Mr. Nidesh Gupta to make a fresh submission. Time allowed will be one hour. Mr. Ranjit Kumar made a reference to the Manipur case which according to him had been referred to a larger bench. In response Mr. Nidesh Gupta mentioned that the Manipur case was subsequently upheld through a disposal of a curative petition. 


The Bench agreed with him at the same time the Bench also clarified that if any petitioner referred to the cut-off date the reference of (Manipur) case will have an impact on our case.  


Incidentally, we had had a detailed and elaborate discussion in the matter yesterday and hence Mr. Gupta could discuss the matter with emphasis and effectiveness.


Now, we (all the petitioners) must prepare a fresh compilation and submit in 2 weeks’ time. Then, we must argue in brief on 3-12-2025. 


This circular is issued with a little delay as (1) our GS is away on personal visit and (2) we wanted the contents to be factual. We do hope that our members will take this in the right spirit.

It is wrong to say that Mr Nidhesh Gupta mentioned about the dismissal of Curative on Manipur judgement. There was no mention about that at all. What he mentioned is totally different. He only said as per many SC decisions (including of 5 judge benches) a judgement referred to larger bench will still be valid till it's correctness or otherwise is decided by such larger bench.
