SUB: A) UNIMAGINABLE  U-TURN OF THE SC BENCH 3 B) STATUS AT DFS/MOF, DELHI 
Dear Members,  
This  is in furtherance to my  brief communication, on 3rd December,  informing  about the adjournment of the case to 4.2.26.  

The appointed Nodal  Advocate by the Bench, our Advocate Shri Ashish Garg, again re-compiled all the documents as per directions of the Bench,  after coordinating  with all the AORs of the petitioners and the respondents and filed it in the Registry within the  defined time. The revised Compilation runs into 6 volumes containing around 4000 pages. It was a herculean job to go through. We, the Sr.  Advocate, AOR and the Nodal  Advocate Shri Ashish Garg were confident that the regular hearing will start and the arguments from the petitioners' side will be completed on 3.12.25.
 
But we were STUNNED, When the Bench of its own said, " We will not take up your case today. We will hear it in the 3rd week of January 26". 
We never thought  that a Bench, which had  all along been giving a message to the Respondents that they would not allow any adjournments, itself had granted a suo motu adjournment for such a long period of two months 
(4.2.26), without assigning any valid reason. 
Even the Advocates concerned were surprised and did not find any 
reason for such a 'U' turn by the Bench. This happened in the 
face of new Chief Justice's recent guide line for quick disposal of cases with "no adjournment to be granted in cases of Regular Appeals" . 
It appears some invisible forces 
interfered in our matter (case) that are against the welfare of LIC Pensioners. In Love and War everything is fair. After all it is a legal battle. 
 
Let us not be disheartened, we shall fight it tooth and nail and succeed in our mission. Please have patience,

 Though, highly disappointed, but not disheartened, I took an opportunity to visit DFS to know, if some progress has taken place on the Issues mentioned in our memorandum , submitted to them on 30.10.25. I met the Under Secretary (Insurance) Mr Abdul Gufran ji in his chamber, he said your letter has been put on the file, but nothing worthwhile has 
happened. He reiterated a vigorous and effective follow up by LIC authorities may yield some results.

We have sought time from the CEO & MD and his team to discuss various pending Issues of the Pensioners and seek their proper resolutions.

It is always rare to get favourable judgments from judiciary for working class unless one is like V.R Krishnaiyer/Gopala Gowda. Even then some other higher number bench will throw it in the dust bin. Will they do it for Rich? No They will favour Rich however much Govt opposes it. One can verify the results of both during British Raj and 78 years of freedom. It is selfishness of belonging to the same class of superiority suppressing working class not only in India but all over the world. Even now infamous 9 9 6 of 72 hours per week is prevailing in Maoist China though working class of Chicago more than a century back sacrificed their lives for 48 hours. When unemployment is worst in India people like Narayana murthy want 9 9 6. Now Indigo Pilots of very high remuneration is agitating to reduce working hours for rest and safety of passengers against greedy employer. Every day productivity is increasing due to technology very rapidly and all the fruits are enjoyed by top 10% and the surplus is denied to working class. TU movement is becoming weak and weak in India as the persons who led it became corrupt by supporting failed political ideologies and dynastic, castiest, corrupt political parties for minuscule seats in parliament and legislatures. No doubt in India real economic conditions of workers are improving 3% PA for the past three decades and not bothered about their seniors who sacrificed a lot though poor for their present improved status. It just reflects a condition may be with some exceptions prevailing in Indian families ie., parents suffered for their kin who in turn ditched them in their old age. This analogy aptly fits pensioners of LIC who themselves behaved in the same manner while they were in service. Karma done its duty in the past, present will do in future also. Every one is for unearned income and unlimited property rights. So no one can remove discrimination in any sphere.
