I would like to invite your kind attention to the judgement delivered by the Supreme court on 10/4/26 in the case of KSRTC pensioners. The court has clearly said that following two different formulas one for payment of DA to in-service employees and another to pensioners is violative of Article 14 of the Constitution and therefore illegal and that one and the same DA/DR formula should be followed for both in-service employees and retiree pensioners.

In the LIC Pension Rules 1995 two different rules for payment of DA to in-service employees and DR to Pensioners are given. In the case of in-service employees 100 pc neutralisation is given upto basic pay of Rs.4800/- while 100 pc neutralisation is given to pensioners upto basic pension of Rs.2400/- only. This is illegal as per the SC judgement.

My basic pension is Rs.4597/-. I am given 100 pc neutralisation upto basic pension 2400/- only and less and less there after. This is illegal. I am entitled to100 pc neutralisation on the full basic pension of 4597/-.

I there demand that you should recalculate the DR payable to me from my date of retirement (1-12-93) on 100 pc neutralisation basis on the full basic pension of 4597/- and pay to me  the difference in  DR with 12 pc compound interest within 30 days from the date hereof.
