- 1.The Petitioners assail the Notification dated 7th July, 2026, issued by the Life Insurance Corporation of India, whereby the process for promotion from the cadre of Higher Grade Assistantto Assistant Administrative Officerhas been initiated. The Petitioners, who are Development Officers4 in the Marketing Wing of LIC, contend that the impugned promotional exercise has been undertaken without first determining the sanctioned strength and actual vacancy position in the AAO cadre, in terms of the
applicable service rules.
- 2.The grievance of the Petitioners is that, under the job-rotation arrangement governed by Office Circular dated 5th March, 2016, officers substantively borne on the AAO cadre continue to be deployed as Assistant Branch Managers5 in the Marketing Wing, while retaining their lien and seniority in the AAO cadre. According to the Petitioners, such deployment restricts the promotional avenues available to DOs, while vacancies in the AAO cadre are simultaneously sought to be filled. The Petitioners therefore seek quashing of the Notification dated 7th July, 2026, and a direction to the Respondents to first determine the actual vacancy position in the AAO cadre, after accounting for the AAOs deployed as ABMs, before proceeding with the promotional exercise.
- 3.Issue notice. Mr. Sandeep Tyagi, Senior Panel Counsel for Respondent No. 1 and Mr. Rajesh Mahendru, counsel for Respondent Nos. 2 and 3, accept notice.
- 4.Counter affidavit be filed within a period of four weeks from today. Rejoinder thereto, if any, be filed within two weeks thereafter.
- 5.Re-notify on 13th January, 2027.
