OUR PENSION CASE
Dear All LIC PENSIONERS,
Mr AS Ramanathan has boosted the sagging morale of the old pensioners by his reassurance that there is nothing ominous in the remark of the Bench that the issue is one to determine whether the power to approve the Board Recommendations is that of the Government or whether LIC can go ahead with implementation of its own Board decision without approval of the Government.
Let us for a moment imagine two scenarios,viz one where Sec 48 is upheld by the Supreme Court and the one where Sec 48 is struck down by the SC.
Scenario 1: Sec 48 is upheld by SC
This means that Government approval is required for implementation of the Board Resolution. But the question arises, whether this will lead ipso facto to allowing the Civil Appeals of LIC thereby setting aside the judgment dt 12/1/2010 of the Single Judge Bench at Jaipur.My answer is 'No'.

Dear Shri KISHOREJI,
It is indeed really painful to read your message that" last several days, I am not well and I am not keeping good health", I think that your tireless efforts and help rendered for smooth sailing of trial of our case in Supreme Court on 20.01.2016 will certainly lead to success and fruition on the said date. The date by itself is very auspicious as many marriages are to be solemnized on that date. So, our success is certain by this time provided all go well as decided and the judges allow the judicial process to continue properly. So, keep your good health and do not worry much about our cases,
I think that the outcome of trial is a foregone conclusion since our cases stand on merits. The order of SC must be unambiguous and easily understandable for all .The in human attitudes of LIC should not be allowed by Justice Dipak Mishra to continue as he did even for animals and stayed Jallikattu in Tamilnadu. There should not be time –limit of three or four weeks for implementation of their order by SC . More time means misinterpretation of the order by LIC of India according to their whims and fancies Supreme Court's order for interim relief on 07.05.2015 came to a naught expiry of eight weeks with extension of two weeks. So, the need of hour is for implementation of their order with immediate effect as justice Mr.M.N Bhandari ordered LIC of India on 12.01.2010 .But this is another matter that even after sixteen years have gone by nothing has happened and LIC of India has no regard for judiciary.Only if there is a threat of "SUO MOTO "contempt action by the SC, in their order when LIC fails to implement within a specified date, LIC may quickly respond.

We have all legal grounds and abundant set of calculations to prove where LIC is going wrong in relation to pensioners.

A V SubbaramanI saw B R Mehta's.post in reply to H K Aggarwal's.In my view both P&H and Delhi HC have concurred with the judgement of Jaipur Hc as issues are same ie 100% DA neutralisation and upgradation of pension for aii retirees.Hence both the cases have been tagged with Jaipur's case to be heard as a single one.Jaipur judgement reigns supreme and if its judgement is upheld by SC .it will automatically apply to the other two.Since P&H and Delhi assns are parties to the case,their arguements also will be heardAAO LIC (retd)
