AN APPEAL ON Consensus on strategy to respond to LIC's counter affidavit to the various writ petitions.

DEAR ALL CASE MANAGERS,

LIC  & UOI have  been directed by Delhi High Court to file their counter affidavits to the writ petitions copy of which were served on them.LIC has since submitted its counter in respect of Hyderabad Association,Chandigarh petitioners ,AIRIEF & AIIPA. Of these, the counters in respect of Hyderabad & AIRIEF writs, the counters have since come in public domain.
On going through them it is clear that many items of response by LIC  are almost common. On observing this phenomenon, one thought occurred to me.
Although the writ petitions of different petitioners may be different, our common objective is to win the legal battle for our securing removal of DR anomaly & 100% DR neutralisation for pre-Aug 1997 retirees & upgradation of pension for all pensioners
In this quest for justice it becomes important that while filing rejoinders to LIC's counters, all the different petitioners do not unwittingly submit conflicting, contradictory or inconsistent responses on the same issue.
It will be therefore ,in my opinion, desirable that the various case managers meet in a conference and agree on a common response on all common points so that the risk of  any unintended damage to the detriment of he interest of pensioners may be avoided.I also happened to discuss this thought with Mr M Sreenivasa Murty who also concurred with me.
All the case managers may kindly ponder over this suggestion so that an early meeting may be held as early as possible so that proper rejoinders are filed well before the next date  of hearing , viz 29/8/2016.
Similar exercise may also be required when UOI submits its counter affidavit/s.
With greetings,
C H Mahadevan
