IT IS TRUE MY FRIEND SHRI M P S RIGHTLY POINTED OUT THAT OUR L I C
HAS ALLOWED THOUSANDS OF ITS OWN PENSIONER EMPLOYEES TO DIE
WITHOUT ENJOYING THE DENIED BENEFITS LEGITIMATELY DUE TO ALL THE
L I C PENSIONERS' COMMUNITY. IT IS REALLY DUE TO US. PENSION IS NOT A
BOUNTY AND IT IS A RIGHT. IT IS CONFIRMED BY SHRI M N BHANDARI ON 12 01 2010. IT WOULD HAVE BEEN BETTER IF L I C COULD HAVE IMPLEMENTED
RIGHT IN TIME. BY DIS OBEYING THE ORDER D/12 01 2010 IT PROVED THAT
THEY HAVE NO RESPECT TOWARDS THE JUDGEMENT OF HIGH COURT.
I REMEMBER THAT THE MADRAS HIGH COURT IN THE YEAR 1972 CONFIRMED THAT L I C IS A STATE . THE ORDER OF THE HIGH COURT IS VALID ON L I C.
DISOBEDIENCE OF AN HIGH COURT ORDER IS NOTHING BUT DIS-OBEYING
THE COURT VERDICTS.

THE COUNSELS OF L I C ARE NOT ON RIGHT PATH THEY ARE MORE ON THE
WRONG PATH. THEY ALREADY LEFT THE RIGHT PATH.

ON THE ISSUE OF BONUS ALSO THEY DID NOT OBEY AND THE EMPLOYEES
HAVE GONE ON STRIKE FOR 14 DAYS, JUSTICE V R KRISHNA AIYER HAS GIVEN A RULING THAT THE PAYMENT OF BONUS WITH ARREARS ON A SPECIFIED DATE. THEN THE L I C WAS RATHER FORCED TO PAY THE BONUS WITH ARREARS. SO THE CLASS CHARACTER OF L I C IS TO IGNORE THE COURT JUDGMENTS.

L I C COUNSEL SAYS TO PAY AS CLAIMED BY PENSIONERS WILL COSTS

9,700 CRORES, BUT IT IS A FALSE FIGURE WHICH WAS CLARIFIED BY SHRI

NITISH GUPTA ON THE VERY MOMENT. JUSTICE DEEPAK MISRA ANSWERED

THAT HE IS NOT CONCERNED WHETHER IT IS 9.7 OR 90.7.

L I C HANDED OVER A CHEQUE OF RS. 1,804 CR. TWO DAYS BACK. TO THE

FINANCE MINISTER OUT OF THE SURPLUS. DOST IT MEAN THAT L I C IS NOT

HAVING MONEY? SECONDLY, THE PAYMENT OF ARREARS ONCE PAID WILL NOT COST MORE THAN 2.5 PERCENT OUT OF THE TOTAL OUT LAY OF L I C. PER YEAR.

DAY AFTER DAY THE PENSIONERS ARE DYING THE NUMBER OF PENSIONERS WERE ARE ON REDUCING SCALE WHERE AS THE FAMILY PENSIONERS ARE ON INCREASING SCALE.

TO A GIGANTIC ORGANISATION IT IS NOT AN EXPENSE, MORE OVER THE

CHAIRMAN HIMSELF MENTIONED THAT THEY ARE HAVING ROBUST PENSION

FUND.

I HOPE THE WISE COUNSELS DO PREVAIL ON L I C AND LET THE WISDOM

DAWN ON L I C BEFORE IT IS TOO LATE.

Bonus Act notified.

> New Delhi : The Union government has notified the Payment of Bonus (Amendment) Act, 2015, allowing lakhs of workers to become eligible to bonus retrospectively from the last financial year, the Labour Ministry said in a statement on Friday.
> While the decision has enthused workers, the industry is unhappy. It has written to the government suggesting ways to simplify bonus distribution. It has said the new Act will lead to financial stress, especially on small and medium enterprises, and as the account books for the previous financial year would have been closed, difficulties are bound to crop up in bonus distribution.
> Under the law, all employees earning Rs.21,000 a month will be entitled to bonus, against the earlier limit of Rs.10,000. Also, the ceiling for bonus calculation has been doubled from Rs.3,500 to Rs.7,000 a month. This will retrospectively come into effect from April 1, 2014. This means an employee earning upto Rs.7,000 per month will be eligible to a bonus on his or her entire salary. If the salary is between Rs.7,000 and Rs.21,000, bonus will be calculated on the salary of Rs.7,000 a month. The notification was published on January 1.

We know that every one is anxious about the fate of wage revision. 

I spoke to co as well as ministry. I can assure you that there is no problem and it is only the unavoidable red tape and we are going to get it without much delay. 

Please be patient. There may be an icing on the cake in the form of 5 day week also coming along with this notification itself. In that case we may have to wait for some more days.  

Sleep tight. Don't worry.

GREAT EXPECTATIONS.

Dear and respected colleagues,

      Namaskar. Now-a-days, time is passing by deadly slow much against our contained emotions and anxiety. Hopes are looming large among all of us that the finality of our testing time won't prolong beyond January. We could re-establish our near-lost supremacy amongst our family members. We could move with our pensioner colleagues with broad smiles and contended hearts. We could feel the change in the approach of sons-in-law and daughters-in-law and chuckle ourselves. Our affection towards our grandchildren might tend to flow immeasurably. It is but natural, if not altogether a humorous desire, dreaming like that.

      We are waiting for our due,reasonable and legitimate share of our fortune since longer than the anticipated period. It is unfortunate that we are forced to fight for this insignificant enhancement of pension,keeping at par with the working employees, through legal processes at the cost of time,energy and money. Being generous towards the general public through their benevolent measures and adopting, surprisingly,quite a different approach towards  their own erstwhile employees, do not speak well of a model employer. It is pathetic that our Prestigious Institution has allowed thousands of its own pensioner-employees to die without enjoying the denied benefits. It has to answer those bitter curses they have left.

      The remaining group of our community is looking upon the Highest Judiciary to spell out with an over all favourable judgment in the current month. Every activist in our Organisation has never failed to advance his counsel to be carried out at the time of this final trial. Let us hope that our Legal Committee would take home all the counsels and see that our Sr.Advocate utilize them at the appropriate occasions with a single motto of winning our side squarely.

   Yesterday, it was reported by us that all formalities regarding wage notification have been completed & the notification is expected any time.

   Since till now it has not been issued, we sought the intervention of our President Shri Prakash Javadekarji who was on a visit to Mumbai today. Javadekarji immediately contacted Anjuli Duggal, Secretary, Financial Services. At that moment she was preoccupied in one of the series of pre-budget meetings going on currently. Later she called up Javadekarji & told him that a spate of pre-budget meetings were going on at the moment, hence, it couldn't be released.

 She also said that the 5 days' week notification was also in the final stage. However, it would be released some time after the wage notification. 

She confirmed that indeed the process was complete & the wage notification would be issued soon.

   We are aware that the employees are feeling disturbed & disappointed over this issue. We are doing our best to achieve our goal. We are continuously applying pressure to release it immediately.

10-year National Savings Certificate discontinued

BENGALURU: National Savings Certificate (NSC) issue IX, which had a term of ten years has been discontinued. The move was approved and notified by the Ministry of Finance on 1 December 2015 and the postal department stopped issuing these certificates 20 December 2015 onward.

Jammu and Kashmir Chief Minister Mufti Mohammad Sayeed breathed his last at the All India Institute of Medical Sciences in New Delhi this morning. He was 79.

The Peoples Democratic Party (PDP) veteran was admitted to the hospital on December 24 with complaints of fever and neck pain after he conducted an exhaustive tour of Srinagar.

The doctors at the AIIMS had put him on ventilator support after his condition deteriorated. Earlier, he was being given oxygen therapy.

SC wants interim mechanism to protect whistleblowers

New Delhi :  Noting that whistleblowers who raise their voice against corruption in government need to be protected, the Supreme Court on Wednesday gave the Centre a week's time to report back on the time required for setting up a foolproof interim mechanism to receive complaints and protect the lives of whistleblowers till a law is enacted in Parliament.

      " Till the time there is a law, you ( the Union Government ) create a mechanism for dealing with complaints of whistleblowers and their safety," a Bench, led by Chief Justice of India T.S.Thakur, told Attorney-General Mukul Rohatgi.

      The Bench then scheduled for January 13 hearing of the public interest litigation petition filed by NGO Parivartan on how whistleblowers who exposed corruption ended up victims of their own courageous act and even faced threats to their lives. Earlier the Centre had said legislation was in the offing.

      The Bill has been passed by the Lok Sabha and there is a demand to send it to the Select Committee of the Rajya Sabha. It deals with handling and probing disclosures made in public interest against corruption, wilful misuse of power or discretion, or criminal offences by public servants.

An Indian teenager scored more than 1,000 runs in a single innings to set a new world record in school cricket.

Fifteen-year-old Pranav Dhanawade broke the previous record of 628 set by Arthur Collins in 1899 on Monday.
But he continued his innings in the HT Bhandari Cup inter-school tournament and reached 1,009 runs.
He smashed 59 sixes and 127 fours in 395 minutes before his KC Gandhi School declared the innings at 1,465 against Arya Gurukul School on Tuesday.

Lodha panel for separate BCCI, IPL governing bodies

New Delhi, January 4
The Justice RM Lodha Committee on Monday proposed separate governing bodies for the Board of Control for Cricket in India (BCCI) and the Indian Premier League (IPL) in a bid to partially segregate their functioning, while also suggesting a one-state-one-member pattern for the board.

New Delhi : A delegation of ex-servicemen on Sunday met Finance Minister Arun Jaitley and submitted a memorandum seeking " corrections " in the One Rank One Pension (OROP) notification, as their protest on the issue entered the 203rd day.

      " A five-member delegation met the Finance Minister and told him that the actual OROP has not been granted. The notification issued has serious flaws and we requested him for corrections in it and granting of actual OROP as per the approved definitions," retired General Satbir Singh said.

      " The Minister has assured us that he will speak to the Defence Minister about our demands," he said.  A group of 100 ex-servicemen including those from Punjab, U.P. and NCR also protested outside Mr.Jaitley's residence. -- PTI.

How the pre- August 1997 retirees are taken for a ride

     DEAR ALL LIC PENSIONERS, 

Further to my post on the above subject,I give below  the  calculations for another Scenario no 3,viz when the process of  DR merger (without removal of the pre-August 1997 DR anomaly) with basic pension is repeated on 1/8/2002 & 1/8/2007,according to which the gross pension will be still less than when  basic pension is revised on 1/8/1997 by the method followed by LIC.

Scenario no 3

After revising the basic pension on 1/8/1997 as per the method adopted by LIC,the same process of merger of DR with basic pension is repeated on 1/8/2002 & 1/8/2007 as well;

Original basic pension : 4700

Revised basic pension as at 1/8/1997= 6708

DR per slab from 1/8/1997 =6708x 0.0023 =15.4284

Total DR as at 1/8/2002=15.4284x 147=2267.9748

Revised Basic Pension as at 1/8/2002 =6708+2268=8976

DR per slab from 1/8/2002 =8976x0.0018 =16.1568

Total DR as at 1/8/2007=16.1568x 154 =2488.1472

Revised Basic Pension on 1/8/2007=8976+2488 =11464

DR per slab as at 1/8/2007= 11464x 0.0015 =17.196

No of DR slabs as at 1/8/2015 =738

Total DR as at 1/8/2015 =17.196x 738=12690.648

Total gross pension as at 1/8/2015 =11464+12691=24155

This is still less than the gross pension of Rs 24226 that will be available as at 1/8/2015 without upgradation if only the pre-August 1997 DR anomaly is removed.

Ultimately it boils down to the fact that justice for pre-August 1997 retirees is possible only if the Pre-August 1997 DR anomaly is removed from the date of retirement or 1/11/1993 ,whichever is later.Any other remedy will only perpetuate anomalies.

Now the pensioners who are parties  in the Civil Appeals have to explore how effectively the anomalies are driven home before the apex court.

Of course, the stress on upgradation for all pensioners has to  continue to guide our legal struggle without any let up.

HAPPINESS ,NOBLE THOUGHT on the EVE OF NEW YEAR 2016

 ONCE   a group of 500 people were attending a seminar. Suddenly the speaker stopped and decided to do a group activity. He started giving each person a balloon. Each person was then asked to write their name on it using a marker pen. Then all the balloons were collected and put in another room.

The people were then let into that room and asked to find the balloon which had their name written on it within 5 minutes. Everyone was frantically searching for their name, colliding with each other, pushing around others and there was utter chaos.

At the end of 5 minutes no one could find their own balloon.
Then, the speaker asked each person to randomly collect a balloon and give it to the person whose name was written on it. Within minutes everyone had their own balloon.

The speaker then began, "This is happening in our lives. Everyone is frantically looking for happiness all around, not knowing where it is.

Our happiness lies in the happiness of other people. Give them their happiness; you will get your own happiness. And this is the purpose of human life...the pursuit of happiness."

Dear all,

Illustration on how Pre-August 1997 retirees are being taken for a ride

DEAR ALL LIC PENSIONERS,
Further to my post on the flawed calculation being adopted by LIC based on their interpretation of the Board Resolution,I happened to work out a sample illustration for an officer who retired on 31/7/1997 to arrive at the gross  revised pension as at 1/8/2015 under two scenarios.

The calculations are given below:

1.Existing Pension

Basic Pension  : 4700

Existing DR   Per slab:   13.57

Total existing DR as at 1/8/2015:  13.57x 1187=16107.59

Total  existing Gross pension :   20807.59= 20808[1]

Scenario 1

Method followed by LIC while depositing amounts in the two High Court Registries.

Existing Basic Pension : 4700

DR as at 1/8/1997 : 13.57x148=2008.36

Basic Pension +DR as at 1/8/1997 =6708

Revised  Basic Pension from 1/8/1997 = 6708

Revised DR per slab from 1/8/1997 =15.4284

Total revised DR as at 1/8/2015 = 15.4284x1039 =16030.1076

Total revised gross pension as at 1/8/2015  = 22738[2]

Scenario 2

If only DR is neutralized as done for in service employees without revising the basic pension as at 1/8/1997;

Existing Basic Pension = 4700

DR per slab if in service DR formula is applied =4700x0.0035 =16.45

Total DR as at 1/8/2015 =19526.15

Total gross pension as at 1/8/2015(even if basic pension is not revised on 1/8/1997)=24226.15 =24226[3]

 Thus ,although the method adopted by LIC may boast of "upgrading pension" as on 1/8/1997, in real terms the pre-August 1997 retirees stand to lose if pension is revised as per LIC's method.They would be better off with a mere equitable DR neutralisation on par with in service employees.

In the present example, the officer is subjected to a loss of Rs 1488 p.m as at 1/8/2015.The cumulative loss from the date of retirement till date will run into at least a few lacs of rupees[Rs 338152* see below] even if full arrears are paid on the basis of the method followed by LIC.

Is it  not now crystal clear that the so called interim relief received by the " fortunate" few is in reality an interim deception?

Total no. of slabs from 01.08.1997 to 31.01.2016=117414

Total Loss=Rs 2.88*117414= Rs 338152
