The Supreme Court on Wednesday sought a response from activist and lawyer Prashant Bhushan on contempt pleas by Attorney General K K Venugopal and the Centre for his tweets allegedly criticising the court over the appointment of M Nageswara Rao as interim CBI director.
Bhushan was given three weeks to reply.
A bench of Justices Arun Mishra and Naveen Sinha said it would deal with the larger question of whether it is open for lawyers or any other person to criticise the court in a sub judice matter which would lead to influencing public opinion.
Criticising the court may also lead to interference in the course of justice, the bench added.
"This issue required to be heard in length, notice issued," it said, listing the matter for further hearing on March 7.
Bhushan, in his tweets, alleged that the Centre, represented by Venugopal, misled the apex court on the issue of Rao's appointment.
On Tuesday, the Centre moved the apex court seeking initiation of contempt proceedings against Bhushan for his tweets and said they amounted to making false statement in a pending case. This was days after Venugopal's contempt petition against Bhushan.
Venugopal, in his contempt plea, referred to the extracts of the minutes of the meeting of the high powered selection committee comprising Prime Minister Narendra Modi, Justice A K Sikri and leader of the largest opposition party Mallikarjun Kharge.
The Centre's plea also referred to the contents of Venugopal's petition and submitted that they be also read as part of its plea.
Venugopal's petition referred to Bhushan's February 1 tweets in which he alleged that the government appeared to have misled the apex court and perhaps submitted fabricated minutes of the meeting of the high-powered selection committee.
Through his tweets, Venugopal said, Bhushan appeared to have deliberately intended to cast aspersions on the "integrity and honesty" of the attorney general who had placed the minutes of the meeting before the apex court during the February 1 hearing.
On February 1, a bench headed by Justice Arun Mishra was hearing a petition filed by NGO Common Cause challenging the Centre's decision to appoint Rao, an IPS officer, as interim CBI director.
Venugopal said in his petition that Bhushan's tweets "scandalise or tend to scandalise and lower or tend to lower the authority of this court".
He said during the hearing on February 1, he had handed over to the bench the minutes of meeting of the high-powered committee held on January 9 and January 10.
According to the petition, signatures of all the three members of the committee — were affixed in the decision taken by the panel.
Venugopal said Bhushan, in one of his tweets on February 1, had said, "I have just confirmed personally from the leader of opposition Mr Kharge that no discussion or decision in HPC meet was taken re-appointment of Nageswara Rao as interim Director of CBI. The govt appears to have misled the court and perhaps submitted fabricated minutes of the HPC meeting."
The attorney general said the statement/confirmation attributed to Kharge could never have been made by him for the simple reason that he himself had signed the minutes of the meeting which also contained the final decisions of the high-powered committee.
"If the minutes of the meeting were to be fabricated, the members of the high powered committee who constituted the majority would have to be parties to such fabrication as their signatures are contained on the very same page on which the decision is recorded in the minutes," the plea had said

The Union Cabinet chaired by Prime Minister Narendra Modi has given ex post facto approval to the revised Office Memorandum (OM) pertaining to the Cabinet Note on "Amendment of Constitution to provide for reservation for Economically Weaker Sections". The OM was approved by the Cabinet on 8th January 2019.

In exercise of powers under Section 2 (1) of Delhi Special Police Establishment (DSPE) Act, 1946, the Central Government constitutes a Special Police Force for investigation in any Union Territory of offences notified under Section 3 of DSPE Act, 1946. The power and jurisdiction of this Special Force can be extended by virtue of Section 5 of DSPE Act, 1946 to any other areas/State not being Union Territory for investigation of any offences or classes of offences notified under Section 3 of DSPE Act, 1946 with the consent of the Government of that State. Further, Constitutional courts can also entrust any case or class of case for investigation in exercise of inherent jurisdiction even without the consent of the respective State Government.
Once general or specific consent is granted under Section 6 of DSPE Act, 1946 by the State Government where the case is registered; or when the case is entrusted by the Constitutional courts, the powers and jurisdiction of members of the DSPE (CBI) may extend for investigation as stipulated under Section 5 of DSPE Act, 1946.
Withdrawal of consent, if any, by a State Government can be effected prospectively and not retrospectively. Further, in the cases which are referred by the Constitutional Courts, the entry of CBI cannot be denied by that State as these do not require the consent of the State.

The Prime Minister, Shri Narendra Modi, today replied to the motion of thanks on the President's Address in the Lok Sabha. He thanked the various Members of the House, for adding vigour into the debate, and sharing insightful points
The opening remarks set the tone of his Government- "A government that works for the people of India, sensitive to people's aspiration, honest, transparent, against corruption and for fast pace of development."
PM said that India has seen remarkable progress in the last four years. From foreign direct investment to steel sector, start-ups, milk and agriculture, aviation, India's progress has been outstanding. "We have become the second largest steel producer, second largest mobile phone manufacturer, 4th largest automobile manufacturer in the world. We are a nation with have a bumper harvest production." he added.
Stating the highlights of his Government, he said one can easily see what his Government has achieved over the past in 55 months is way ahead of what has been achieved in the last 55 years -"Sanitation coverage has crossed 98% ,over 10 crore toilets have been built for our people. In 55 years, 12 crore gas connection were given. In last 55 months, 13 crore gas connections were given and 6 crore were Ujjwala. The speed of the work done and for whom the work was done, you decide for yourself." he said.
About opposition, PM said that people have seen the work a government with an absolute majority can do and they have seen the work of his Government. He added that they do not want a 'Mahamilavat' government and it won't be successful.
PM asserted that one is free to criticise him but in doing so they should not criticize the nation,
Talking tough on corruption, PM said his Government is working tirelessly to bring the corrupt people to book.
On Benami Law, he said it was his government that implemented Benami Law and now people are getting caught for having the benami properties.
Speaking on Rafale, PM Modi said Defence Minister had answered to all the allegations in detail and the controversy was being created by those who think no defence deal can be done without kickbacks.
About NPAs, PM said previous Governments left behind a legacy and those
who fled the country are today crying on Twitter. "They are saying that I had taken Rs 7,800 crore but the government has attached properties worth Rs 13,000 crore". he added.
PM also said that about 20000 NGOs have shut their operations after the government sought details of their funding and these numbers may increase in future.
Explaining how the NDA Government has been working hard to ensure ease of living for all, he said the price rise has been checked as compared to the previous Governments.
Expressing his commitment towards a healthy India, PM said the prices of medicines and medical and surgical equipments have been brought down.
On the employment front, PM said maximum job growth has been in the transport sector. In the past four years, more than 6 lakh new professionals have joined the workforce and they have added to more number of jobs for the people. He talked about how more than 1.80 crore people have been enrolled under Employees Provident Fund over between September 2017 to November 2018 , over a span of just 15 months , out of which 64% are below 28years age. PM also told the LokSabha that more than 1.20 crore people have been registered under National Pension System or NPS.
Stating that India's foreign policy has brought India to the fore in the global arena, PM said people hear what India has to say. He added that before Paris agreement was finalised, top world leaders used to talk to India. PM also made it clear that India will be friends with both Israel and Palestine as well as with both Saudi Arabia and Iran.
Lauding the role of generation next in charting the progress of India, he said "Those born in the 21st century are now going to be voters and thus, they will play a role in shaping India's progress."
PM summed it up saying that his Government will always fulfil the aspirations of the people of India.

Presenting key achievements of the Modi government ahead of the Lok Sabha polls, President Ram Nath Kovind on January 31 had asserted that it has worked to build a "New India" after assuming power in 2014 and infused new hope when the nation was passing through "uncertain times".
During his over 60-minute address in the Central Hall of Parliament, Kovind spoke on issues ranging from Rafale jet deal and 10 per cent reservation for the general category poor to the triple talaq legislation, the Citizenship Amendment Bill and the state of economy.
Kovind described the 10 per cent quota as historic.
"Prior to the 2014 General Election, the country was passing through a phase of uncertainty. After the elections, my government assumed charge and vowed to build a New India. A New India with no place for imperfect, corrupt and inertia ridden systems," he said.

सितंबर 2017 से लेकर नवंबर 2018 तक यानि करीब-करीब 15 महीने में लगभग 1 करोड़ 80 लाख लोगों ने पहली बार प्रॉविडेंट फंड का पैसा कटाना शुरू किया है। इनमें से भी 64 प्रतिशत 28 साल से कम आयु के हैं।
इसके अलावा एक और तथ्य है। हमारे देश में मार्च 2014 में करीब-करीब 65 लाख लोगों को नेशनल पेंशन सिस्टम (NPS) में रजिस्टर किया गया था। पिछले साल अक्तूबर में ये संख्या बढ़कर करीब 1 करोड़ 20 लाख हो गई है। क्या ये भी बिना नई नौकरी के ही हो गया।
एक और आकड़ा है। हर साल इनकम टैक्स रिटर्न भरते समय, Non-Corporate Taxpayers भी अपनी आय घोषित करते हैं। इन्हें खुद Salary नहीं मिलती, लेकिन ये लोग यहां नियुक्त लोगों को Salary देते हैं।
पिछले चार वर्षों में देश में ऐसे 6 लाख 35 हजार नए प्रोफेशनल्स जुड़े। क्या आपको लगता है कि एक डॉक्टर ने अपना क्लिनिक या नर्सिंग होम खोला है, तो उसने सिर्फ एक व्यक्ति को ही नौकरी दी होगी, या कोई चार्टर्ड अकाउंटेंट सिर्फ एक व्यक्ति को नौकरी पर रखकर अपना दफ्तर चला रहा होगा? नहीं।
हज़ारों करोड़ रुपए की लागत से 99 लटकी पड़ी सिंचाई परियोजनाओं को पूरा किया जा रहा है:
