As was apprehended, our cases could not be taken up today. Shri Nidhesh Gupta, Sr Advocate was present in the court and after seeing the slow pace of disposal of the short time cases, he made a mention at 2.00 PM to take up our cases on priority pleading that matter pertains to the senior pensioners who are in the age group of 70s and 80s. More than 25000 pensioners are expired without getting justice. Shri Ranjit Kumar, Sr Advocate for LIC opposed the prayer telling that one of the petitioners – petitioner in person is expired and a counter appeal is filed by LIC against him which is tagged with the other SLPs, so no proceedings should be held unless the deceased is represented by LRs. He also stated that full amount of interim relief ordered by this court is already paid so the cases need not be taken up on priority. Shri Nidhesh Gupta countered and informed that arrears from the IR paid were recovered by faulty implementation of DHC order so no substantial relief could be given to the pensioners. Justice Surykant responded by saying that bench would go fast and your turn may come, but Shri Nidhesh Gupta expressed apprehension. Bench said to see the position. After item no. 17, it was told that remaining cases will be taken up after 14/11/2023. Before the bench called it a day, Shri Nidhesh Gupta again requested for an early specific date with our cases on the top of the list. Other advocates were also making request for early hearings. Responding to Shri Nidhesh Gupta Justice Suryakant told that your cases will be taken up next Tuesday. In view of Diwali Holidays in SC, our case may come up on 21/11/2023. Let us wait for the order.
