The much expected case in the Supreme court came for hearing today.
Our case was heard from 10.45 am to 1.00pm and again from 2.00 pm to 3.00pm.
Our senior Advocate Shri. Nidhesh Gupta started placing our case nicely.
Points covered
1.Denial of 100% neutralization of DR to pre 1.8.93 retirees and the incorrect DR formula ordered by Delhi high court.
2.Rule 35 of pension rules by which pre 1987 retirees were offered pension Updation based on Consumer Price Index and later retirees were denied the said updation.
3.Chairman and Managing directors are being allowed pension Revision on every wage revision and other employees of the corporation receiving pension from the same fund are denied the said revision.
4.As per Rule 56 of pension rules the said revision was extended to two cadre (chairman and MDs) and denial to other cadres is discrimination and against article 14 of the constitution.
5.LIC can't say insufficiency of funds because it is their duty to provide sufficient amount to the fund as per pension rules. The extra amount may be a drop in the ocean.
6.He pointed out the board resolution passed and sent to GOI for pension Updation during 2001.
7.Senior advocate explained about the fresh options allowed to employees to join in the pension scheme for those who did not opt for pension initially and also the recurring expenses incurred on them.
8.CCS pension rules 2021 and rule 56 of LIC pension rules were reffered.
9.Senior advocate clarrified that the our prayer is not OROP but its only a parity of pension.
10.He explained the relevant portion of the various pay commissions and their relevance to our case.
Many of the earluer relevant judgements of Supreme Court, including the Kallakurichi Taluka employees vs Govt of Tamilnadu, which are in our favour.
Our legal committee expert Shri. M. P. Agnihotri was consulted during the presentation of the case and the senior Advocate told the court that he is the expert on those points.
Our General Secretary Shri. Ranjan D Sarkar was also seen present in the court.
Even after 3.15 hours presentation there are points to be placed.
So the SC adjourned our case to 24.09.25 on which day after completion of our advocate other parties points will also be heard. Then LIC advocate and attorney general of india may present their points.
Let us hope for the best.
