Proceedings before Hon Supreme Court
I have seen the mail of Sri Mahadevan. Our Chandigarh team,represented by Sri Mahadevan and Sri Murthy, have their point of view,though it is rightly conceded that Jaipur Bench judgement forms the basis of judgements of Chandigarh and Delhi High Courts. Similarly, our Jaipur team has also their point of view.But the larger question is whether Chandigarh team,with their lawyers could have not sit with Jaipur team and their Sr. Counsel at Delhi and discussed all the issues threadbare with all the pros and cons and arrived at the best possible unified strategy to give a befitting reply to LIC and UOI.
Retired Class I Officers Federation lost valuable time of five years and nine months,because,in my opinion,at least after Jaipur Judgement of Jan.2010, they should have kept aside their own interpretation of Board resolution and immediately moved Jaipur Bench,if they did not want to join hands with Sri Asthana to keep their separate identity,and should have obtained similar judgements from Single and Division Bench.Today we are talking of advanced age of retired officers.
Whatever has happened has happened and done can not be undone and still there is time.Because on 30th the main issue may not be heard and applications of condonation of delay in filing of appeals by LIC and UOI may be taken up.
We should learn from past and stop adopting different strategies and both the teams should decide an unified approach for future hearings,because dissensions will not help anyone,rather LIC and UOI may exploit the situation to drag the main issue as much as possible to tire us out in our efforts,and more so financially.
Sri Nerurkar informed me in his mail that Class I Federation will support both the teams in S.C. in the matter of pension upgradation.Delhi case is on DA anomaly and it is not a party in other two cases.Still if it is legally possible,it will be a welcome step at least at this belated stage.In that eventually,it's representatives may also participate in joint discussions to formulate a common strategy.
Hope and pray that wiser counsel shall prevail and veiled criticism and different approaches shall stop forthwith and a unified strategy to the main issue shall be adopted in future hearings.
