Discrimination - a hydra-headed monster!!!

Dear Mr Mahadevan,
     "whether pensioners are employees" - Yes, going by the clarification of the highest court in the land obtained through no less than an interlocutory (whew!) application when it ordered : "Pay 20% to the employees".     "whether pension is the same as salary." - Yes, going by the treatment of pension under the Income Tax Act, 1961.     I know that you are very well aware of the legal position and so that your questions are rhetoric and it doesn't require a humble Ramanathan to tell you this but still thought it may not be taken amiss if I answered rhetorically.
    
"How are we going to  get this discrimination removed?"
     By collective action, of course, in as much as the legal position is quite clear vide the pronouncement of the Supreme Court and the provision in the Income Tax Act, 1961.      Two other instances of discrimination readily coming to mind are :     (1) Pensioners are paid revised Dearness Relief only half-yearly while for serving personnel it is quarterly.     (2) Transfer of pensioner's records from one D O to another to suit his/her convenience is not allowed in Chennai (Madras) where there are two D Os while it is allowed as a matter of course in Delhi, Mumbai (Bombay) and Kolkata (Calcutta) where also there are more than one D O.
     The records of all pensioners were with Chennai D O 1 until the formation of Chennai D O 2 and records were transferred to Chennai D O 2 ARBITRARILY without so much as a by-your-leave of the affected pensioners.
     I tried getting my records transferred from Chennai D O 2 to Chennai D O 1 for more than three years sending frequent representations to ' the powers that be ' (what more can a powerless pensioner do?) citing the instance of policyholders, who are customers of PS Dept., having the freedom of selecting the office of LIC which should service their policies and contending that pensioners who are customers of OS Dept. should, likewise, have the same freedom just as it is obtaining in Mumbai, Delhi and Kolkata but got nowhere.
     Finally it was through the very kind and empathetic intervention of Mr R.B.Kishore with Mr Siddhartthan, Zonal Manager, Southern Zone, that my case was treated as a ' special one ' and my records were transferred from Chennai D O 2 to Chennai D O 1 with a caveat that "this should not be taken as a precedent"!
