PENSIONERS LATEST POSITION & HOPES FOR IMMEDIATE FUTURE

 Dear Sri Bhargava,

   1)Thanks for ur email. Our pranams to U. U are a veteran, Septuagenarian,Super Sr Citizen.U seem to be worried.Ur position, my position, why ALL pensioners position is the same.LIC & MOF/UOI are yet to settle,our long-drawn legal battle goes on & on in Hcs,SC ,now again to Delhi HC, we have to keep our fingers crossed till 31/8/2016 .All these hard journey for 18 years without any final decision by SCourt has given lot of pinpricks,sorrow,anger & frustration.Our countrys systems, Courts inordinate delay,no empathy on the part of management, no consideration of even genuine demands of aged pensiones by MOF/UOI  all have contributed to this state of affairs.Whatever , let us be calm & composed.

2)Nothing is lost.It becomes clear Hon SC Bench immediately did not want to dispose of by a Final order but packed all respective HCs  writs to Delhi HC Bench to be constituted within a Month,40% IR within 6 weeks ,Affidavits/Applications/Addl Issues whatever ,time for LIC to file Counter Affidavit ,HC Summer vacation 6 June to 5 july & final hearings from 6 July to 31 August 2016 ,Delhi HC Bench to dispose of with FINAL ORDERS.Ultimately, that will go to SC Bench & that may need very little time, as Hon SC Bench has already whetted all important issues clearly.Many paras breathe optimism,aged pensioners reality situation Hon SC Judge has kept in mind ,also criticising LIC for not being graceful to Elders & equally mild reprimand to MOF/UOI for not taking a decision for long.So, the heart of the matter is implicitly & explicitly clear to them & to us now.

3)Only matter which they demanded Delhi HC to litigate was Constitutional validity of Rule 3A of Appendix mainly.The negative comment of SC was in r/o LIC Board Resn.where suddenly SC Bench categorically affirmed that any action of LIC Chairman is circumscribed by power to be given or delegated by way of Rules & within that Rule which gets nod in Parliament,Chairman can act

Lots of case laws we have quoted in original writ of Jaipur ,Sr Counsel Nidish Gupta played a pivotal & stellar role on 31/3/2016  Any loose ends or more explicit or incomplete pleadings as SC has observed will be taken care of.AIRIEF has arranged on 2/5/2016 at Delhi OBs/ Legal  Committee ,AIRIEF.

 4)Even now 40 % IR ordered to be paid by SCrefers to ALL pensioners who retired before 1/8/1997 Pensioners includes Regular Pensioners & Family Pensioners,always, & ALL RP & FP of pre/-8/1997

5)What is more important than this simple fact is HOW LIC will calculate 

  For that I pray U had seen my EMail 3days before of GIST of TALKS with Chief Per,CO

I have impressed upon him twice within 5/6 days then that 6 weeks will expire soon, most probably by 20 MAY 2016 

   So, I pleaded in his liason with IT CO for quick calculations, CORRECT PRINCIPLE as enunciated by Hon Judge SC "as per Rule 3A of APPENDIX IV of Pension Rules 1995

I emphasised that SAME PRINCIPLE LIC adopts  for Wage Fixation be followed ie BASIC PAY as at 1/8/2012,then only customary Merger of DA with Basic Pay etc etc u must be aware

 6)  AIRIEF has clearly cautioned LIC that they will invite wrath of SC & Delhi HC Bench,if still they stray away from accepted ORDER of SC 

3A is intended for Post 8/1997 & Hon Misra has rightly dragged LIC to correct method, a step AHEAD to enable him to give principled Final Order in f/o pensioners as He himself was the author of that SC verdict dr 1/7/2015in r/o Rajasthan Librarians & others

    7)Under the above circumstances,any remittance for LEGAL FUND must be sent avowedly to AIRIEF ONLY pioneering legal Kurukshetra Legal battle  for 18 yrs & have delivered very many benefits to all pensioners.We have an ALL INDIA reach.We are the ONLY Pensioners Fedn comprising ALL CLASSES of EMPLOYEES, CLASS 1,2 3, & 4. We had EC/GC meetings all 18 yrs on dot.We released many Booklets so useful to pensioners.We are the ONLY ONE INSCE PENSIONERS FEDN to have our own WEBSITE decorated with a variety of news, views,writeups, Charts & Tables ,Sri RKsahnis commendable updated Tables on any worthwhile matter of pensioners.,Souvenirs,contacts with CO Top Mgt, & many more

8)You have referred in ur email that you have been  “sending my share for legal fighting fund I sent to AIRIEF Rs. 2000 /- as against 1700/- being 10 % as asked  for which a receipt no 940 dated 20-08-2013 was sent to me.”I am not sure where u have become member of RIEA of nearby DO ,as part of AIRIEF.Please inform the Name of the Association written on top of the Receipt you are referreing to.Many good things happened even after 8/2013 till 31/3/2016

9)Our AIRIEF standards are Life Membership Rs 500,Life Subscriptions for AIRIEF HM Varistha Vaani Qly Rs 750

Now legal Donations may have to be significant as all collections,as per GS,AIRIEF would have come to rockbottom.Any amount Rs 2500 -5000 is worthwhile for the magnitude of efforts put in by AIRIEF & Sri Asthana  for the pending legal battle to become Historic for twin benefits including pension upgradation

Please request all ur pensioner friends to contribute to AIRIEF LEGAL FUND liberally,without any other consideration to strengthen our will & determination to fight to the last.Victory will be in sight as our case still is as solid as ever

We have written to the Chairman and ED(P), LIC, CO , Mumbai today, 17-4-2016 on the following:

(1)WHEN LIC C O is going to issue INSTRUCTIONS and when the ordered amount of 40% is going to be paid to the PENSIONERS and the FAMILY PENSIONERS and that the  calculation sheets should be given along with the payments. 

(2) As per the circular ref: CO/PERS/ER – A/124/2016 dated 16^th April 2016 the premium for the sum insured slabs  payable by the pensioners  family pensioners will be heavy and is almost 150% of the premium paid for 2015-2016. The  C O  may mitigate the burden either (1) by increasing the basic sum insured to double the limit in each class,   or, (2) by revising the basic pension – forthwith.

Friends, we wish to  inform you that every pensioner and family pensioner should contribute to the Legal fund of the AIRIEF which ALONE is in the vanguard of the legal struggle for the last 18 years. True, the S C order has not granted our prayer FULLY - but there are bright indications of our achieving our goal. PLEASE,  THEREFORE, contribute liberally to our legal fund in ANTICIPATION of the 40 % Payment.
