DELHI HC ORDER DATED 8.12.2016



Dear Sh Mehrotra,
It is a pleasure to learn that RIEA JAIPUR held a Meeting on Dec 25  at the residence of  Sh KML ASTHANAJI who is not well due to shoulder fracture. This initiative of Jaipur retirees is indeed a timely gesture to re-boost his morale and energies to fight the legal battle successfully as ever. I have always been strongly lending all support to him because of his untiring, determination & devotion to the  pensioners legitimate demands and AIRIEF have also been lending him the helping hand. But after SUPREME COURT orders of 31.3.16, there has been unfortunate developments due to wrong ( in my & majority of pensioners views) interpretations of the order by  filing fresh WRITS by HYDERABAD followed by AIIPA and also AIRIEF, which have created more confusion, delays and extra (avoidable) expenses on pensioners. As per para 29 of SC order DT March, 31 Writs in Rajasthan HC JAIPUR & PH HRY HC CHANDIGARH were also transferred to DELHI HC with grant of liberty to the PETITIONERS to file amended documents, if so required, in support of their demands, and also directions to DELHI HC to decide on issues referred by 31 August, 2016. There was no need to file fresh writs instead all Assns/Federations should have given all support (legal, moral & financial) to the existing PETITIONERS. But it did not happen. And now there is confusion, wrong self made reportings, blames, self styled plans particularly by HYDERABAD are being floated. No body is ready to accept boldly the blunder these organisations have committed, nor ready to keep fresh writs in ABEYANCE , nor ready to form a united front to collectively carry on the legal fight expeditiously and in the right direction as suggested by SH KML Asthana- the Pioneer & our crusador, who is unfortunately unwell. You must have seen my humble submissions in this regard to all the PETITIONERS, case managers & LEADERS, but of no avail. Sh Asthanaji also not happy the way our case is going on or being handled by others. Since RIEA, JAIPUR, with enlightened leaders like you, are with Sh Asthana, I am sanguine that future course of action in DELHI HC will be in the required directions.
