MY RESPONSE TO MR G N
SRIDHARAN
Mr G N S is good at provoking others
to respond to his writings. Many a time,
it becomes difficult for me to resist
responding. Now he has drawn inspiration from Mr P P Dhamija’s post to come out
with his ‘clarificatory’ remarks. I expect this response of mine to also meet some points raise by Mr P P
Dhamija. I don’t know where from Mr GNS got the idea that Mr M Sreenivasa
Murty having never been a practicing
lawyer got himself enrolled only after our litigation heated up in Supreme
Court & Delhi High Court. Perhaps, he does not remember Mr Murty having appeared in the Chandigarh High Court
on 20/7/2015 successfully arguing against LIC’s application for withdrawal of
20% of the amount deposited in terms of order dt 24/8/2014 of the said HC.The
application of LIC was dismissed as withdrawn and LIC was directed to file a
reply in the COCP No 2975 of 2013 after Mr Murty argued against LIC counsel’s
plea..I would like to go a step further and state that the active involvement
of Mr MSM has contributed to the case heating up at Supreme Court to the
advantage of pensioners whereby the case
of pensioners was kept alive by SC by remanding it to DHC.But for the IA No 5
filed by Mr MSM in the SC on behalf of Hyderabad Association praying for making
it an Intervenor against the IA No 3 of 2014 in C A No 9223 of 2013 of the
Federation, there would have been a potential damage to the interests of the pensioners by
possible dilution of the benefits that were expected to flow from the LIC Board Resolution. I would like to submit
humbly to Mr G N Sridharan that with lesser length of practice by Mr Murty than
the former, he has been quite effective in the conduct of the cases besides
imparting transparency and speed in communicating to the stakeholders. His
appearing in the Delhi HC briefly with
the permission of the Bench and clarifying some technical points is no mean achievement
As regards we two, taking care of our
career interests,Mr GNS needs to know that Mr Murty like many others in his batch, missed the opportunity
of occupying higher positions in his career thanks to the long period of lull in promotion caused by the litigation by
HGAs’ Association. But within that constraint he got his promotions by sheer
merit including a foreign assignment as a recognition that he richly deserved.
As a superior to him in the official hierarchy for three years before our
retirement, I can unhesitatingly and authentically vouch for his merit and official performance achieved.
As far as my career is concerned, I
missed my promotion to the cadre of ADM once, but fortunately made up for the
same when I got promotion to the cadre of DM
along with my batch mates only losing my inter se seniority. I have worked in 4 Zones of the Corporation
& Central Office at places far away from my home town and at no time
maneuvered for my retention in the same/preferred place on transfer/promotion.
I am personally satisfied that I deserved all the benefits that I got in my
career devoting my full time and attention to my official exigencies. I did not
seek any favour or plum postings at any time and took assignments in their
stride. I was fortunate to get good
bosses. I for one believe that an employee has to decide his priorities
in the course of his career path and if he/she decides to engage in activities
that are likely to divide his/her attention to official duties however
justified or legitimate they may be, then he/she has to be prepared to make
sacrifices in career advancement. There is no point in regretting later of
having got a raw deal. This is only mu humble view.
I thank Mr GNS for his appreciation
of my initiative to form an Association at Hyderabad which was not an easy task
considering resistance from some quarters. But over a period of 6 years
after the Association was formed, the manner in which the
Federation was moving through not paying attention to the interest of the
pensioners as a whole but focusing on the benefits only to a segment of
pensioners-that too not completely in their interest- as proved from the
IA filed in 2014( of which I was not
made aware as an EC member) praying for
the depositing of an inadequate amount
as was done in the Jaipur Registry caused disillusionment among our Association
members and we were pushed to the wall to
disaffiliate our Association from the Federation through a unanimous resolution on 3/8/2014 in
an Extraordinary General Body meeting
& to merge it with the independent Registered Association of retired
Class I Officers at Hyderabad as our suggestion to withdraw the IA filed in the
SC by the Federation was not accepted. The necessity to intervene in the IA No
3/2014 through our own IA forced us to decide to disaffiliate from the
Federation.
It will be clear from the above that
our disaffiliation had a sound rationale in contrast to what Mr GNS has
mentioned in para 2 of his post. There is no ego involved in a collective
unanimous decision taken after due deliberation. It is not difficult for
readers to perceive where the ego lies.
What is the need for Mr Murty to
brainwash pensioners who are capable of independent thinking and judgment
developed through decades of working experience in the Corporation? The so
called ‘Bharat Darshan’ doesn’t extend beyond meeting and interacting with
pensioner friends and is nothing to be satirical about. I can assure Mr
Sridharan that Mr Murty’s plan for a meeting of pensioners at Mumbai is very
much on the agenda and he will definitely get to know of it when it happens. It
is not the numbers that is important, but the number of satisfied members is
all that matters. The numerical strength of Hyderabad Association is a little
over 200, but ever since we filed our
Writ Petition in DHC we have been receiving overwhelming support from over
thousands of pensioners from all over the country from not only Class I cadres, but other cadres as
well as experienced from their
communication & financial support. In the same vein can I also ask Mr GNS
what he could achieve from his “Hyderabad Darshan” despite his getting an
audience of 40 pensioners in February 2016?
I am sorry that Mr GNS has used the
term” succumbed group” to make his point related to age. I feel that the usage
is an insult to fellow pensioners. Personally I hold aged people-especially
octogenarian pensioners including Mr Sridharan –in high respect. I consider it
a sin to criticize people who are in advanced ages, because every one of us –if
we are fortunate to be alive-is bound to pass through the positives and
negatives of such phase. Having said that, I also expect qualities like a
reasonable capacity to subdue one’s ego, more maturity, large-heartedness,
tolerance and openness to appreciate others’ points of view etc to accompany
the ageing process .All of us need to remember that most of us, pensioners ,
are in the last 10 % in the scale of
experienced longevity and why not make
this period happy for ourselves and
others?
Greetings.
C H Mahadevan
