Madras HC order - Thiagarajan

This is a judgment  dated 24/4/2023 of Madras High Court by a Single Judge.This is a favourable judgment for an individual petitioner who is a pensioner of United India Insurance Company.The HC has ordered providing the benefit of Rule 54 B to the retired Administrative Officer of UIIC.The Rule 54 B and Rule 55  of the General Insurance(Employees) Pension Scheme 1995  are identical with Rules 55 B & 56 of LIC Pension Rules 1995.

If the judgment is replicated for a retired Administrative Officer of LIC, he will also have to be fixed pension as per CCS Pension Rules 1972 & CCS (Commutation of Pension) Rules 1981.In other words, Rule 56 will have to be implemented for all pensioners and not merely for those LIC retirees covered by Rule 55 B.
It is not known whether the Single Judge Bench judgment of the Madras High Court has been appealed against. We can  be sure of the finality of the judgment only if the decision is upheld by the Supreme Court.
