Rule 66 of CCS Pension Rules 2021 need not be invoked for claiming upgradation of pension for LIC employees.For one thing Rule 66 only relates to Central Government employees and we cannot cite that rule demanding upgradation for LIC pensioners.For another, even before the CCS Pension Rules 2021 were notified, Central Government pensioners were getting upgradation in pension w e f 1/1/1996 on implementation of 5 th CPC recommendations by the Central Government. So what we need to emphasize upon is the need for implementation of Rule 56 of LIC Pension Rules 1995 which will ensure application of CCS Pension Rules in the same manner done to Central Government employees,to LIC employees as well.We should also stress upon the discriminatory Rule 55B of LIC Pension Rules where Rule 56 has been selectively applied for Chairmen & Managing Directors of LIC who retired after 1/1/1996 and this violates Articles 14 & 21of the Constitution as per the ratio in D S Nakara case judgment. This has to be fought in the Supreme Court. The approach of the Government seems to be to give whatever they want first to Banks' pensioners and then only to LIC pensioners.
We will get before them only if the Supreme Court delivers a judgment in our favour earlier.
